Engineering Contracts. STA may terminate this Contract, in whole or in part, because of Contractor’s failure to fulfill Contract obligations. STA shall terminate by delivering to Contractor a notice of termination specifying the nature and extent of default and effective date of termination. Upon receipt of such notice, Contractor shall: Immediately discontinue all services affected (unless the notice directs otherwise); deliver to STA all data, drawings, specifications, reports, estimates, summaries and other information and materials accumulated in performing this Contract, whether completed or in process. STA may complete the work by Contact or otherwise and Contractor shall be liable for any additional cost incurred by STA. If, after termination for failure to fulfill Contract obligations, it is determined that Contractor was not in default, the rights and obligations of the Parties shall be the same as if termination had been issued for STA’s convenience.

Engineering Contracts. Any engineering contracts for review and approval by DHHL, which contracts shall be with an engineer or engineering firm which is licensed to engage in the engineering business in Hawaii and is approved by DHHL.
Engineering Contracts. The Engineering Contracts Unit provides two different types of servicesconstruction contracting and professional services contracts. The construction contracting unit conducts the contracting process for construction projects including contractor prequalification, advertisement for bids, opening of paper and electronic bids, award and execution of the contract, and issuance of the notice to proceed once signed by the Chief Engineer. The Engineering Contracts Unit conducts the contracting process for professional services (engineers, architects, surveyors and industrial hygienists), including consultant prequalification, issuance of the Request for Proposals (RFP), facilitation of the selection process, contract negotiations, and execution of the contract.

  • BUILDING SERVICES CONTRACTS In compliance with Article 9, Section 230 of the New York State Labor Law:

  • PUBLIC WORKS AND BUILDING SERVICES CONTRACTS Work being done under a resulting Authorized User Agreement may be subject to the prevailing wage rate provisions of the New York State Labor Law. Such work will be identified by the Authorized User within the RFQ. See “Prevailing Wage Rates – Public Works and Building Services Contracts’ in Appendix B, Clause 10, OGS General Specifications. Any federal or State determination of a violation of any public works law or regulation, or labor law or regulation, or any OSHA violation deemed "serious or willful" may be grounds for a determination of vendor non-responsibility and rejection of proposal. SHORT TERM EXTENSION In the event a replacement Contract has not been issued, any Contract let and awarded hereunder by the State, may be extended unilaterally by the State for an additional period of up to 3 months upon notice to the Contractor with the same terms and conditions as the original Contract including, but not limited to, prices and delivery requirements. With the concurrence of the Contractor, the extension may be for a period of up to 6 months in lieu of 3 months. However, this extension terminates should the replacement Contract be issued in the interim. PROCUREMENT INSTRUCTIONS Authorized Users should refer to the documents attached as Appendix G – Processes and Forms Templates for specific instructions on the usage of this Contract. OGS reserves the right to unilaterally make revisions, changes, additions and/or updates to the documents attached as Appendix G - Processes and Forms Templates without processing a formal amendment and/or modification. SPECIFICATIONS During the term of the Contract, the Authorized User may request Product specifications for particular items that have been included by the Contractor in its Pricing Pages. These specifications will be provided by the Contractor at no cost.

  • Price Adjustments for OGS Centralized Contracts Periodic price adjustments will occur no more than twice per year on a schedule to be established solely by OGS. Pricing offered shall be fixed for the first twelve (12) months of the Contract term. Such price increases will only apply to the OGS Centralized Contracts and shall not be applied retroactively to Authorized User Agreements or any Mini-bids already submitted to an Authorized User. Price Decreases Price decreases may be made at any time. Additionally, some price decreases shall be calculated in accordance with Appendix B, section 17, Pricing.

  • SUB-CONTRACTS (a) The Servicer may sub-contract or delegate the performance of all or any of its powers and obligations under this Agreement, provided that (but subject to Section 3.2(b)):
