Enforcement Mechanisms. The state shall have the mechanism to restrain immediately and effectively any person engaging in any unauthorized activity or operation, which is endangering or causing damage to public health or the environment as applicable to the program requirements. The Commission shall also have the means to sue in courts of competent jurisdiction to prohibit any threatened or continuing violation of any UIC program requirement. Additionally, the Commission shall have the mechanism to access or sue to recover in court civil penalties and criminal remedies as established in the Texas Water Code, Chapter 27, Subchapter F, and 40 CFR §145.13.

Licensee acknowledges and agrees that (a) Licensed Software will only operate on servers on which valid license keys are installed and (b) Licensed Software may contain certain other mechanisms to enforce the Licensed Storage Amount limitation and the other limitations set forth in this Agreement. Cloudian will have no liability of any kind in connection with any inability of Licensee to use the Licensed Software or the Cloudian Product in excess of such limitations due to such mechanisms or any other causes.

Additionally, LDNR shall have the mechanism to access or sue to recover in court civil penalties and criminal remedies as established in La. R.S. 30:1106, La. R.S. 30:18, and 40 CFR 145.13.
Enforcement Mechanisms. The IAIOB shall serve as the primary international entity responsible for overseeing the implementation of this Treaty, monitoring compliance, and addressing any potential violations at an international level. The IAIOB will work closely with each State Party’s NARA to ensure harmonized and effective implementation of the Treaty’s provisions. The IAIOB and NARA will collaborate in sharing best practices, addressing challenges, and promoting transparency in the development and use of AI technologies. Each State Party shall cooperate with the IAIOB in the exercise of its functions in accordance with this Treaty and shall not interfere with the IAIOB’s activities. State Parties shall consult, directly among themselves, or through their NARA or the IAIOB or other appropriate international procedures, including procedures within the framework of the United Nations and in accordance with its Charter, on any matter which may be raised relating to the object and purpose, or the implementation of the provisions, of this Treaty. Both the IAIOB and each respective NARA shall establish appropriate mechanisms for the verification of AI systems to ensure they conform to the standards and regulations set forth in this Treaty. The specific details of those mechanisms shall be outlined in an annex to this Treaty. Each State Party shall, in accordance with its constitutional processes, take any necessary measures to implement its obligations under this Treaty. In particular, it shall take any necessary measures: To prohibit natural and legal persons anywhere on its territory or in any other place under its jurisdiction as recognized by international law from undertaking any activity prohibited to a Party under this Treaty; To prohibit natural and legal persons from undertaking any such activity anywhere under its control; and To prohibit, in conformity with international law, natural persons possessing its nationality from undertaking any such activity anywhere. In case of suspected non-compliance, the IAIOB, in coordination with the respective NARA, shall undertake an investigation. If the State Party in question is found to be in non-compliance, the IAIOB shall recommend appropriate measures to bring the State Party back into compliance, which may include technical assistance, capacity-building support, or referral to the United Nations Security Council. Enforcement Mechanisms. 1. Carrying out of a review of the legal and regulatory framework applicable to tax administration in order to improve, if needed, the procedures related to: (a) tax collection, investigation and auditing; and (b) the application of sanctions to tax evaders.
Enforcement Mechanisms. The EUTCA includes mutual commitments not to lower standards on the environment, workers right and climate change and includes provisions ensuring mutual enforcement. There is a mutual right to “rebalance” the agreement in the event of significant divergences between the UK and the EU that may impact trade. This rebalancing clause is much stricter than measures found in other EU trade deals. The UK has also agreed to accept common principles on state aid and to the concept of an independent competition agency to assess those state aid regimes. The ECJ will continue to play a role in Northern Ireland, which will remain subject to EU single market and customs union rules.
Enforcement Mechanisms. SFMTA will bring to the attention of DOT any false, fraudulent, or dishonest conduct in connection with the Program so that DOT can take the steps (e.g. referral to the Department of Justice for criminal prosecution, referral to the DOT Inspector General, action under suspension and debarment or Program Fraud and Civil Penalties rules) provided in Section 26.109. Contractor may also be subject to penalties and/or a debarment action under the San Francisco Administrative Code, or liquidated damages for failure to meet particular contract SBE requirements. Failure to comply with the requirements of the SBE Program constitutes a material breach of contract and will be grounds for termination of the contract. Funds may also be withheld under the Contract pending investigation of a complaint of violation of the SBE Program.
