End User License. If Licensee has obtained an End User License to the Software for Licensee’s own internal business purposes, the following terms shall apply and take precedence over any preceding inconsistent or conflicting terms: Subject to the terms and conditions of this Agreement, Windward grants to Licensee during the License Term (subject to Section 6 of the Agreement), non-exclusive, non-transferable, non-sublicensable license to copy and install the particular number of copies of each Software application licensed by Licensee from Windward or its authorized agent or partner, for the purpose as set forth in the applicable Documentation for the Software and to the extent permitted by Licensee’s payment of applicable license fees, if any, under a Windward approved License Type and/or your Software license key subject to the Software product specific terms specified in this Agreement, the technical restrictions of the Software and/or any additional licensing terms specified by Windward via Documentation, notification and/or Windward’s License FAQ located on the Windward website (xxx.xxxxxxxxxxxxxxx.xxx), and other applicable limitations set forth in an Order (“End User License”). Each individual Software application may be installed and used solely on the number of computers set forth in the Order, if applicable, and used for Licensee’s business operations in accordance with the applicable provisions of this Agreement. The License to the Software is limited to the quantities specified in each applicable Order.
End User License. Where the Serial Number obtained is prefaced with PN-TIFLE-, this means an End User License has been obtained by the Licensee. Under an End User License, the Licensor grants the Licensee the right to use the Software in a Microsoft Windows ® interactive user session and excludes the right to use the software in a Windows Service or other non-interactive environment. An interactive user session is a normal logged in user using the Software directly. End User License can be used for Windows Terminal Server(s) and Windows Terminal Service Client(s); however, a separate activation is required for each Terminal Server Client (“User”). A Terminal Server can be licensed for all Terminal Server users by purchasing a Terminal Service License.
End User License. The Distributor is authorized to offer and distribute the Products to End Users under the terms, conditions and restrictions as provided in an End User License Agreement and Terms of Service, as provided by the Company in the Documentation or as may be attached hereto as Exhibit D (the "End User License Agreement"). The Company and the Distributor will cooperate to establish mutually acceptable procedures to reasonably assure that End Users enter into the End User License Agreement. The Distributor shall provide End User License Agreement to the End User and assure that such End User License Agreement is agreed to by the End User before the consummation of any transaction and the Distributor shall accept the return of the Products from End Users who do not wish to be bound by the terms and restrictions of the End User License Agreement and any such return shall be on the account of the Distributor and the Distributor shall be fully responsible for any expenses and costs incurred as a result of such return.
End User License. “End User License” shall mean an end user license to one or more Company Products granted by an Acquired Corporation in the ordinary course of business and consistent with past practice.
End User License. MINOLTA shall only distribute the Deliverables to Customers for delivery to End Users. MINOLTA shall distribute the Deliverables after obtaining the written assent of the Customer to cause all End Users to agree, as to the software and other proprietary technology included in the Deliverables, to the terms of a standard T/R Software License, and a form of which shall be supplied to MINOLTA by T/R. MINOLTA shall make no representations or warranties on behalf of T/R. MINOLTA shall make no representations to Customers or End Users or other third parties regarding the Deliverables except as set forth in the applicable documentation therefor provided by T/R. MINOLTA will be responsible for all conversions, translations and localizations necessary for use of the Deliverables by End Users in the various countries included within the Territory.
End User License. Any software included in or with the Systems is subject to license and not sale. HKIS shall distribute the software pursuant to HKIS' standard software license agreement, the minimum terms of which are attached hereto as Schedule 6. In jurisdictions in which an enforceable copyright covering the software exists, such license agreement may be enclosed in the packaging or start-up screen of the System or software (i.e. a "shrink wrap" or "click-wrap" license). In all other jurisdictions, unless otherwise agreed, HKIS will ensure that each End User signs a copy of such Agreement prior to receipt of the Deliverables. T/R, or such other party from which T/R has acquired the right to grant such license, shall retain full title to the Software and all copies thereof. Neither HKIS nor its Customers shall have access to or rights in the software source code. Except as otherwise provided herein, neither HKIS nor its Customers or End Users shall have the right to copy, modify, reverse engineer, or disassemble any software or part thereof. HKIS shall make no representations or warranties on behalf of T/R. HKIS shall bind T/R to no representations HKIS makes to its Customers or End Users or other third parties regarding the Deliverables except as set forth in the applicable documentation therefor provided by T/R. HKIS will be responsible for all conversions, translations and localizations necessary for use of the Deliverables by End Users in the various countries included within the Territory. T/R will provide translation services on a per language basis at fees specified in Schedule 1. Translated versions will be delivered after the American English version in accordance with a jointly agreed schedule.

Each User account requires a separate licence even on the same Computer. End User License can be used for Windows Terminal Server(s) and Windows Terminal Service Client(s); however, a separate activation is required for each Terminal Server Client (“User”). A Terminal Server can be licensed for all Terminal Server users by purchasing a Terminal Service License.
End User License. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, non- sublicensable, limited and revocable license to use the App for personal use only on an Android phone or tablet ("Android Device") owned or controlled by you in accordance with these Terms ("User License"). Any use of the App in any other manner, including, without limitation, resale, reverse-engineering, disassembling, redistribution, transfer, modification or distribution of the App or text, pictures, music, barcodes, video, data, hyperlinks, displays, and other content associated with the App ("Content") is prohibited. You may not rent, lease, lend, sell, transfer, redistribute or sublicense the App. If you sell or transfer ownership of your Android Device to a third party, you must remove the App before doing so. You may not copy (except as expressly permitted by this Agreement), decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by licensing terms governing use of any open-sourced components included with the App). If you breach any of these restrictions, you may be subject to prosecution and damages. This Agreement and User License also governs any updates or upgrades to, or supplements or replacements for, this App unless separate terms accompany such updates, supplements or replacements, in which case the separate terms will apply. The User License is effective until terminated by you or NPP Development LLC, with or without written notice. Your rights under the User License will terminate automatically without notice from NPP Development LLC if you fail to comply with any Terms or terms of the User License. Upon termination of the license, you shall cease all use of the App and destroy all copies, full or partial, of the App.
End User License. Subject to your compliance with these Terms and your payment of the applicable fees, we hereby grant you a personal, limited, revocable, non-transferable, non-sublicensable, non- exclusive, non-commercial license to use the Products. Except as expressly permitted by these, you cannot: (a) rent, lease, lend, sell, distribute, sublicense, or otherwise transfer or make available the Products; or (b) copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, alter, mimic, adapt, translate, or create derivative works of the Products, any updates, content or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open source components included with the Products).
End User License. If you are an End User—that is, you have acquired an Intel server board or server system primarily for your (or your employer's) own use and not for redistribution or resale—Intel grants you a limited copyright license to copy or otherwise install and run the Software on such server boards or systems and to make one archival copy. You may not transfer the Software to another person or entity unless you also transfer such server board or system, your transferee agrees to be bound by the terms of this license agreement, and you keep no copies.
