Employment Provisions. A. TEACHER TRANSFERS When vacancies, new positions, or extra-duty assignment vacancies occur in the school system, teachers within the system are entitled to apply for those positions through transfer requests. A vacancy shall be deemed to exist whenever a continuing position 1) is no longer staffed or 2) will not be staffed in the future by the employee currently assigned to the position. A vacancy shall not be deemed to exist whenever a continuing position will be staffed by a teacher currently employed by the district who will be reassigned to the position and the teacher currently employed in the position is also being reassigned. Information regarding vacancies and impending vacancies is maintained at the Board of Education. Transfers to another building or changes in grade or subject shall be given consideration. Requests for such transfers shall be submitted in writing to the Superintendent. All transfer requests are subject to position availability. A list of vacancies which occur during the school year shall be posted at all school sites, one (1) week prior to being filled except in emergencies. First notice of available positions will immediately be sent by district e-mail to all teachers and a printed copy will be sent to each site during the school year. A list of known and possible vacancies in bargaining unit positions for the ensuing school year shall be posted at all school sites by May 15. A copy of posting will be provided to the TEA president. Teachers who are interested in being notified of vacancies during the summer break will leave notice at the central office in writing at the end of school indicating their interest along with an address and telephone number where they can be notified. If a position becomes open, interested teachers will be contacted. (July 2010) The vacancy list shall include:

Employment Provisions. 1. No qualified individual with handicaps shall, solely on the basis of handicap, be subjected to discrimination in employment under any program or activity that receives Federal financial assistance from the Department.
Employment Provisions. 10.4.1 Vacancies that occur in certified positions will be posted on the school employment website. This location must be used exclusively for job postings. Any vacancy that occurs within five (5) days of the first day of instruction may be filled after posting the position for forty-eight (48) hours. Posting of vacancies in the summer months will be on the school employment website. Job postings will clearly set forth the position, site or pool, closing date if determined by the hiring manager, and certification required. Any teacher who desires to fill such a vacancy shall submit a transfer application to the Human Resources department.

Except as set forth in Schedule 4.19, no Seller Entity has, or within one (1) year has had, any policy, practice, plan or program of paying severance pay or any form of severance compensation in connection with the termination of employment. Except as set forth on Schedule 4.19, each Seller Entity has in the past complied and is in compliance in all material respects with all applicable Laws and regulations respecting labor, employment, fair employment practices, terms and conditions of employment, and wages and hours. Employment Provisions. 2.01 TEMPORARY/PART TIMECONTRACT Temporary Contract - A contract with a definite starting and concluding date. All certified personnel will be initially hired on a temporary contract. Any certified employee recommended for re- employment for a second school year will be re-hired on a temporary contract. This second year contract will advance to a continuing contract if the employee has demonstrated effective performance through the evaluation process for that school year. Effective performance is defined as reaching at least a 2.8 cumulative numerical rating for evaluations using the TLE Qualitative Evaluation Model. Pursuant to meeting this effective rating, the employee's contract status will be advanced to continuing status for re-hiring consideration by March 3pt of that school year. Part-Time Contract - A continuous contract in which Members of the Bargaining Unit shall have all benefits including career status. If the position becomes a full time position the Member may be offered said position. The Member shall be notified by April 10 if the position is to be non-renewed. In the case of non-renewal the Member shall have the right to a Board hearing. When a Member has taught in a part-time position for three or more years, he/she shall be offered the position if his/her current position is made full time. (1999, 2015)
