EMPLOYEES RETURNING TO WORK AFTER ILLNESS OR INJURY. (a) In any case where an employee provides notice to the Employer of his intention to return to work following an absence due to illness or injury, including absences covered by Workers' Compensation Board benefits, the employee will be entitled to be reinstated in his former position as soon as the Employer has been able, without incurring any penalty, to provide the appropriate notice, as required by the provisions of Article 9.13, to any other employee who might have been scheduled to work in place of the returning employee during that employee's absence.
