Employees Assistance Program. The Employer recognizes that the abuse of alcohol and/or drugs constitutes an illness and employees so affected while undergoing recommended treatment will have the benefits he/she is entitled to in this grievance procedure and will retain seniority. The Employer and the Union will establish a mutually agreed upon procedure to refer employees to a recognized agency for treatment.

Employees Assistance Program. Section 1 The Union and the Agency shall have as a goal early identification and motivation in rehabilitation of possible cases of alcoholism, drug abuse, or other problems which affect job performance. Both Parties agree to cooperate in aiding the employee whose work performance indicates a problem by referring the employee to the Employee Assistance Program (EAP) for professional screening and diagnosis. Employee participation in the EAP program shall be voluntary, however supervisors may refer employees to this program. The Agency will assist employees in developing an understanding of their rights, tools, methods and programs available to them. The employee must work to correct the problem, or they are subject to the existing disciplinary procedures for unsatisfactory job conduct and to adverse action procedures for unsatisfactory job performance.
