Employee Status and Benefits. 20.03.1 From and including the day the injury occurs until not more than two (2) years from the date of injury or the employee's sick leave credits are exhausted, whichever occurs first, the employee shall be deemed to be an active employee and earn all benefits. Notwithstanding, the employee shall not earn any benefits during the period of non-permanent (seasonal) layoff. For the period beyond two (2) years after the date of injury or when the employee's sick leave credits are exhausted, whichever occurs first, the employee shall receive an indefinite leave of absence.

After the expiration of the project or temporary appointment, and while the employee is in receipt of payments from the Workers' Compensation Board, the one hundred and eighty (180) calendar day period of non-employment, for purposes of determining a break in service, will not start until the Workers' Compensation Board deems the employee fit to return for duty.
