Employee Relationship. (1) The services to be performed under this contract do not require the contractor or its employees to exercise personal judgement and discretion on behalf of the judiciary. The contractor's employees will act and exercise personal judgement and discretion on the behalf of the contractor, as directed by the contractor's supervisory personnel, and in accordance with the contract terms and conditions.

Employee Relationship. It is expressly understood that no employer/employee relationship is created by this Agreement nor does it cause KCTCS/JCTC to be an officer or official of the OCBOE. By executing this Agreement, the parties hereto certify that its performance will not constitute or establish a violation of any statutory or common law principle pertaining to conflict of interest, nor will it cause unlawful benefit or gain to be derived by either party. Employee Relationship a. Employee Relationship. The Agreement presents an opportunity for Employee to perform Employee’s job responsibilities off-site, and Employee’s commitment and obligations to Omaha Theater Company shall not change. As communicated above, Employee acknowledges and agrees that Employee must answer all work-related emails and/or requests in a timely manner. Employee shall regularly communicate with Employee’s supervisor regarding Employee’s daily and weekly expectations and give regular progress reports on work assignments. Employee is expected to be actively engaged throughout the workday, as is expected if Employee were working on-site. Any violations of this Agreement by Employee may be subject to discipline, up to and including cessation of work from home arrangement and/or termination of employment.
