EMOTIONAL DISTRESS. The University shall have the right to terminate this Contract and require that the Resident vacate the Premises and all University Housing facilities if the University determines that the Resident’s conduct prevents them from meeting the necessary eligibility criteria to continue to live in residence, with or without reasonable accommodation. In all such cases, determination shall be made by the Vice President, Student Affairs, the Vice Xxxxxxx for Campus Wellbeing and Crisis Intervention, or their designee, on an individualized basis and in consultation with appropriate offices and USC policies. In cases of serious emotional crises or incidents of drug/alcohol overdose, substance abuse, eating disorders that present a substantial risk of harm to the Resident, self-harming conduct and/or suicide ideation that is disruptive to other residents’ peace and enjoyment and/or presents a substantial risk of harm to the Resident, or other similar behavior, the University shall have the option, but not the obligation, to permit the Resident to remain in University Housing subject to a contingency agreement containing such specific provisions as the University deems appropriate in such circumstances. Such contingency agreement shall, without limitation, entitle (but not require) the University to monitor the Resident's situation and/or conduct. Without limiting the foregoing, if the Resident has attempted suicide, engaged in suicide ideation, threatened suicide, or written suicide notes, the University shall have the right to require that the Resident receive specific permission to remain in University Housing from the Vice President, Student Affairs, the Vice Xxxxxxx for Campus Wellbeing and Crisis Intervention, or their designee following an individualized assessment of the Resident’s situation including consideration of available medical and other evidence and in consultation with other appropriate USC offices, e.g., the Office of Student Accessibility Services. Such permission will normally require the Resident to provide an assessment and recommendation from a qualified psychological or medical practitioner as to the Resident's condition and/or fitness for occupying University Housing. The University may require the Resident to be assessed by University Health Services.
EMOTIONAL DISTRESS. CBC hereby disclaims all liability to the Guest for damages for emotional distress, mental anguish or psychological injury of any kind, under any circumstances, when such damages were neither the result of a physical injury to the Guest, nor the result of that Guest having been at actual risk of physical injury, nor were intentionally inflicted by CBC.

Such behavioral contract shall, without limitation, entitle the University to monitor the Resident's situation and/or conduct. Without limiting the foregoing, if the Resident has attempted suicide, commented about committing suicide, threatened suicide, or written suicide notes, the University shall have the right to require that the Resident receive specific permission to remain in University Housing from the Vice President, Student Affairs or his/her designee. Such permission will normally require the Resident to provide an assessment and recommendation from a qualified psychological or medical practitioner as to the Resident's condition and/or fitness for occupying University Housing.

  • MENTAL DISORDER As defined in the 32 CFR 199.2: For the purposes of the payment of benefits, a mental disorder is a nervous or mental condition that involves a clinically significant behavioral or psychological syndrome or pattern that is associated with a painful symptom, such as distress, and that impairs a patient’s ability to function in one or more major life activities. A Substance Use Disorder (SUD) is a mental condition that involves a maladaptive pattern of substance use leading to clinically significant impairment or distress; impaired control over substance use; social impairment; and risky use of a substance(s). Additionally, the mental disorder must be one of those conditions listed in the current edition of the Diagnostic and Statistical Manual of Mental Disorders (DSM). “Conditions Not Attributable to a Mental Disorder,” or V codes (Z codes in the International Classification of Diseases, 10th Revision, Clinical Modification (ICD-10-CM)), are not considered diagnosable mental disorders. Co-occurring mental and substance use disorders are common and assessment should proceed as soon as it is possible to distinguish the substance related symptoms from other independent conditions.

  • DEFAMATION The Parties covenant and agree that in no event, and at no time during the Term or at any time thereafter, shall either of them disparage, denigrate, slander, libel or otherwise defame the other or the other’s businesses, services, properties or assets, or employees, personnel, agents, or representatives.

  • Assault Any case of assault upon a teacher which occurs in the line of duty shall promptly be 20 rights and obligations with respect to such assault, and its legal assistance to the teacher in 21 connection with handling of the incident by law enforcement and judicial authorities. In such 22 event, the following shall apply:

  • Serious Illness Should a participant be unable to take the leave when scheduled because of serious injury or illness occurring before commencement of the leave, he/she may cancel the leave and receive payment as in Article 12.8.3.9 or, with the consent of the College, defer the leave to a time mutually agreeable, not to exceed one (1) year.

  • Recall from Layoff Full-time and regular part-time nurses shall be recalled in the order of seniority unless otherwise agreed between the Hospital and the local Union, subject to the following provisions, provided that a nurse recalled is qualified to perform the available work:

  • Material Breach of Contract In the event Contractor fails to deliver the product and services as contracted for herein, to the satisfaction of the City of Sparks or otherwise fails to perform any provisions of this Contract, the City, after providing five (5) days written notice and Contractor’s failure to cure such breach within the time specified in the notice, may without waiving any other remedy, make good the deficiencies and deduct the actual cost of providing alternative products and/or services from payment due the Contractor. Non-performance after the first notice of non-performance shall be considered a material breach of contract.

  • Defendant’s Breach of Plea Agreement If the defendant commits any crimes, violates any conditions of release, or violates any term of this plea agreement between the signing of this plea agreement and the date of sentencing, or fails to appear for sentencing, or if the defendant provides information to the Probation Office or the Court that is intentionally misleading, incomplete, or untruthful, or otherwise breaches this plea agreement, the United States will be released from its obligations under this agreement. The defendant, however, will remain bound by the terms of the agreement, and will not be allowed to withdraw his plea of guilty. The defendant also understands and agrees that in the event he violates this plea agreement, all statements made by him to law enforcement agents subsequent to the execution of this plea agreement, any testimony given by him before a grand jury or any tribunal or any leads from such statements or testimony shall be admissible against him in any and all criminal proceedings. The defendant waives any rights that he might assert under the United States Constitution, any statute, Rule 11(f) of the Federal Rules of Criminal Procedure, Rule 410 of the Federal Rules of Evidence, or any other federal rule that pertains to the admissibility of any statements made by him subsequent to this plea agreement.
