Common use of EMERGENCY SHUT DOWN Clause in Contracts

EMERGENCY SHUT DOWN. It will not be a violation of this SCWA, when the Contractor considers it necessary to shut down work in whole or in part to avoid the possible loss of human life and/or because of an emergency that could endanger the life and safety of a worker. In such cases, workers will be compensated only for the actual time worked. In the case of a situation described above whereby the Contractor requests workers to stand by, the employees will be compensated for the “stand by time.” In the event of any conflict, the appropriate local collective bargaining agreement shall apply.
