Emergency Costs. Any and all costs incurred due to an emergency affecting the safety of persons or property and related to the performance of the Work.

Other costs approved in advance by the Owner. Limitations on the Cost of the Work. All costs not identified in Articles 4.4.2 and 4.4.3 shall be considered a part of the CM/GC’s Fee. Without limiting the effect of the foregoing, the following items are specifically excluded from the Cost of the Work: Rental Rates. Rental costs of machinery and equipment, except as specifically provided in Articles 4.4.2 and 4.4.3, above, and as limited herein. The Owner will in no event consider a rental rate in excess of 80% of the rate set forth in the latest edition of the "Compilation of Nationally Averaged Rental Rates for Construction Equipment" of the Associated Equipment Distributors unless the rates proposed in excess of 80% are supported by proof satisfactory to the Owner that the excess rates are reasonable, the decision of the Owner to be final, binding and conclusive on all parties. Rental rates shall be payable only for the actual time the equipment is required on the site in the reasonable opinion of the Design Professional whose decision in this respect shall be final, binding and conclusive on all parties.

Emergency Costs. If the Insurer’s prior written consent cannot reasonably be obtained before Defence Costs or Pre-Claim Inquiry Costs are incurred, then the Insurer shall give retrospective approval for such reasonable costs, subject to the Sub- Limit specified in Item 5 of the Schedule.

In the event that Office Owner deems it necessary, in its sole judgment, to make emergency repairs to any portion of the Project to prevent injury or damage to Persons or property, Office Owner shall have the right to do so, it being understood that Office Owner shall nevertheless advise each other Owner of such emergency condition as soon as reasonably possible, including the corrective measures taken and the cost thereof. If the cost of the emergency action exceeds $10,000 in Constant Dollars, and if such cost is not, in Office Owner’s sole but reasonable judgment, attributable solely to a particular Element, then Office Owner shall submit a supplemental billing to each other Owner, together with evidence supporting such cost, and each other Owner shall pay its share thereof within thirty (30) days after receipt of such billing. If the cost of the emergency action does not exceed $10,000 in Constant Dollars and such cost is not attributable solely to a particular Element, then such costs shall be included as part of the Common Costs for that year. If the cost of the emergency action, in Office Owner’s sole but reasonable judgment, is attributable solely to a particular Element, then Office Owner shall submit a supplemental billing to the Owner of such particular Element, together with evidence supporting such cost, and the Owner of such particular Element shall pay the cost thereof (whether such costs exceeds $10,000 in Constant Dollars or not) within thirty (30) days after receipt of such billing. -24-

If the Insurer’s prior written consent cannot be reasonably obtained before Defence Costs, or other fees, costs and expenses otherwise covered under this Policy are incurred, the Insurer will pay such costs. The amounts payable under this extension shall reduce the Limit of Liability stated in the Schedule and is sub-limited to 10% of the Limit of Liability per Claim and in the aggregate for the Policy Period unless specified otherwise in the Schedule.
Emergency Costs. If the Insurer’s written consent cannot reasonably be obtained before Defence Costs, Investigation Expenses, Prosecution Costs, Mitigation Expenses, Public Relation Expenses or Bail Bond Costs are incurred with respect to any Claim or Investigation, the Insurer will give retrospective approval for such costs provided they would otherwise fall to be paid within the terms and conditions of this Policy wording of up to a maximum amount of 10% of the Limit of Liability which shall apply in the aggregate for the Policy Period (such limit shall be part of and not in addition to any sub-limits specified or the aggregate Limit of Liability shown in Item 2 of the Schedule). The Insured shall give written notice of any emergency costs incurred within 14 days.
