Emergency/Bereavement Leave. A. Thirty six hours (36) of leave may be granted to an employee at the discretion of the district superintendent for the purpose of dealing with an extreme emergency including but not limited to bereavement of immediate family. This leave will be charged to the employee’s accrued sick leave. B. A teacher may use an additional nine (9) hours of sick leave for bereavement not otherwise covered. These hours are non-cumulative. A teacher may use an additional nine (9) hours of sick leave in the event roads are closed by the Montana Department of Transportation.

Emergency/Bereavement Leave. Emergency leave may be granted by the appointing authority or designee without loss of pay for emergency purposes, which shall include: critical illness or death in the immediate family; if an employee is subpoenaed to appear before a court and such other situations considered meritorious by the appointing authority or designee who shall certify allowance or disallowance of the emergency leave sought. Emergency leave shall be supplementary to and not in restriction of, annual leave as herein provided. Use of emergency leave shall not replace the provisions of FMLA leave referenced under Article 25.2 of this contract. Employees whose emergency leave event qualifies for FMLA leave under current federal law, must apply for FMLA leave and provide the necessary documentation to determine the need. Pay for FMLA qualifying events will be covered by the applicable provisions of FMLA leave. For the purposes of this section, immediate family shall be defined as being a spouse, and children of the employee, children of the spouse, grandmother, grandfather, mother, father, sister and brother of either the employee or the employee’s spouse, or others at the discretion of the appointing authority or designee. This provision shall not be construed to supersede the payment of wages at the overtime rate in accordance with Article 15 of this contract for subpoenas related to the employee’s work for the Town of Goffstown.

Emergency/Bereavement Leave. 35.1 Teachers shall be granted up to five (5) days each year for bereavement in the case of a death of a member of the teacher’s immediate family or for events of an emergency nature. An emergency is defined as an event of catastrophic or unforeseen nature which would keep a teacher from performing their duties. Emergency/Bereavement leave is granted with full pay. IMMEDIATE FAMILY DEFINITION: This includes both first and second degree relations by affinity and consanguinity (by blood and marriage). First degree relations are defined as father, mother, husband, wife, and children. Second degree relations are defined as grandfather, grandmother, grandchildren, brothers, and sisters. For all leave purposes, any leave more than one (1) hour and less than three (3) hours will be considered ½ day charged to the appropriate leave category. Any leave of one hour or less is not chargeable and will be worked out with the principal. 35.2 For deaths outside the immediate family (or additional days for deaths within the immediate family), a teacher may apply to the Principal who is authorized to grant leave chargeable to sick leave. 35.3 For deaths outside the state, additional time up to three (3) days may be granted by the Principal.
Emergency/Bereavement Leave. The Employee may take up to four (4) days of paid leave during the term of this Agreement for any emergencies or deaths in the Employee’s immediate family. For the purposes of this Agreement, immediate family is defined as a spouse, child, parent, brother, sister, grandchild, grandparent, or in-law. Upon termination of this Agreement, the Employee will have no right to be paid for unused days of emergency or bereavement leave.
Emergency/Bereavement Leave. Emergency leave, the days used to be deducted from sick leave, may be used pursuant to this Section. 2.1 Up to but not to exceed five days with full pay shall be allowed for absence due to death of a spouse/partner, child (including step-children, xxxxxx children, or children under legal guardianship), siblings or parents (including step-parents or step-siblings) and up to but not to exceed two days with full pay shall be allowed for absence due to death of grandparents (including step-grandparents) and comparable in-laws to persons listed above. Absence due to death of a family member not listed above or for death of a close friend or for critical situations may be approved by the Superintendent or their designated agent. Any absence beyond such days shall be unpaid days approved by the supervisor. 2.2 One day of absence due to illness in the immediate family, or a critical family situation where no other arrangements are possible may be approved by the supervising administrator, with any additional day(s) of absence to be approved by the Superintendent, with the right of appeal to the Board. 2.3 One day for critical situations not covered previously making it impossible for the employee to report for work may be allowed as determined by the Superintendent or the Superintendent's designated agent. Bad weather in the local area or poor driving conditions are not considered a legitimate excuse for a day when school is in session. 2.4 Any u n u s u a l case of absence not covered above will be considered upon the presentation of the facts in writing to the Superintendent or their designated agent.
