Emergency Access. Landlord shall have the right to enter the Premises at any time without notice in the event of an emergency.

In the event of any emergency, as determined by City, City may, at its sole option and without notice, enter the Premises and alter or remove Xxxxxx's Personal Property on or about the Premises. City shall have the right to use any and all means City considers appropriate to gain access to any portion of the Premises in an emergency. In such case, City shall not be responsible for any damage or injury to any such property, nor for the replacement of any such property and any such emergency entry shall not be deemed to be a forcible or unlawful entry onto or a detainer of, the Premises, or an eviction, actual or constructive, of Tenant from the Premises or any portion thereof.

If in the opinion of the Scheme Operator any emergency exists whether in the Accommodation Unit or elsewhere to permit the Scheme Operator its employees and others at any time to enter the Accommodation Unit of the Resident and deal with that emergency and all repairs necessary as a result of the Scheme Operator and its employees entering the Accommodation Unit as a result of the emergency shall be borne by the Resident.

If safe and practicable, the City will notify Licensee of any emergency that requires the City to remove and replace a City Pole and allow Licensee to remove its Equipment before the City removes or replaces a City Pole in an emergency situation or other exigent circumstances. But if in the City’s sole judgment it is not safe or practicable to wait for Licensee to perform the work or where such delay would cause significant delay to or otherwise compromise public safety or services, the City will remove the Equipment from the City Pole, exercising reasonable care to avoid damage. The City will hold the Equipment for retrieval by Licensee, and Licensee will have the right to reinstall the Equipment or equivalent Equipment at Licensee’s expense on the repaired or replaced City Pole in accordance with Article 7 (Installation of Equipment). As provided in Section 9.4 (Emergencies), the City’s removal of Licensee’s Equipment in emergency or exigent circumstances may not be deemed to be a forcible or unlawful entry into or interference with Licensee’s rights to the License Area.
Emergency Access. Pathnet is responsible for providing a contact number that is readily accessible 24 hours a day, 7 days a week. Pathnet will provide access to its collocation space at all times to allow GTE to react to emergencies, to maintain the building operating systems (where applicable and necessary) and to ensure compliance with OSHA/GTE regulations and standards related to fire, safety, health and environment safeguards. GTE will attempt to notify Pathnet in advance of any such emergency access. If advance notification is not possible GTE will provide notification of any such entry to Pathnet as soon as possible following the entry, indicating the reasons for the entry and any actions taken which might impact Pathnet's facilities or equipment and its ability to provide service. GTE will restrict access to Pathnet's collocation space to persons necessary to handle such an emergency. The emergency provisioning and restoration of interconnection service shall be in accordance with Part 64, Subpart D, Paragraph 64.401, of the FCC's Rules and Regulations, which specifies the priority for such activities. GTE reserves the right, without prior notice, to access Pathnet's collocation space in an emergency, such as fire or other unsafe conditions, or for purposes of averting any threat of harm imposed by Pathnet or Pathnet's equipment upon the operation of GTE's equipment, facilities and/or employees located outside Pathnet's collocation space. GTE will notify Pathnet as soon as possible when such an event has occurred. In case of a GTE work stoppage, Pathnet's employees, contractors or agents will comply with the emergency operation procedures established by GTE. Such emergency procedures should not directly affect Pathnet's access to its premises, or ability to provide service. Pathnet will notify GTE point of contact of any work stoppages by Pathnet employees.
Emergency Access. If safe and practicable, the SFMTA will allow Licensee to remove its Equipment prior to removing or replacing a Pole in an emergency situation or other exigent circumstances. But if in the determination of the SFMTA it is not practicable to wait for Licensee to perform the work or where such delay would cause significant delay to or otherwise compromise public safety or services, the SFMTA will remove the Equipment from the Pole, exercising reasonable care to avoid damage. The SFMTA will hold the Equipment for retrieval by Licensee, which may reinstall said Equipment or equivalent at Licensee's expense on the repaired or replaced Pole. The City's removal of Licensee's Equipment in emergency or exigent circumstances shall not be deemed to be a forcible or unlawful entry into or an interference with Licensee’s license to the Premises. (See Section 9.3.)
Emergency Access. In the event of an emergency that requires access to the Site not covered under an issued permit, notice shall be given telephonically to INDOT within one (1) hour of accessing the Site via the emergency contact number provided in Section 8.14. If a live INDOT employee is not available, a telephonic or voicemail message will be sufficient notice. Within twenty-four (24) hours of the emergency, Operator shall submit a ROW permit application for the work performed and for any work yet to be completed within the Site.
