Eligible Checks. You agree that you will use the Service to make deposits to your Card account only by transmitting to us Check Images of “Eligible Checks”. Eligible Checks are checks drawn on U.S. domiciled financial institutions in U.S. dollars that are: • payroll checks; • insurance agency checks; • cashier’s checks; • money orders; • rebate checks; • stock dividend checks; • checks issued by a business to you; • tax refund checks; • federal, state and municipal government checks; and • personal checks. Eligible Checks must also meet the following criteria: • the valid MICR number, check number and name of the payer are all commercially imprinted on the Original Check; • your signature (endorsement) is legibly written in ink on the Original Check along with the wordsFor Mobile Deposit Only”; • the payer’s U.S. street address and zip code are written on the Original Check; • the check is submitted within ninety (90) days of the check date; • the image quality must meet the standards established by the American National Standards Institute, the Board of Governors of the Federal Reserve, and any other regulatory agency, clearing house or association; and • the check does not contain erasures and was not altered.

Eligible Checks. You can only scan and deposit original paper checks (as defined in the Expedited Funds Availability Act/Regulation CC) that are drawn on or payable through U.S. financial institutions. We are not obligated to accept for deposit any check image that we determine to be ineligible for Mobile RDC including but not limited to: o Checks payable to a third party; o Demand drafts or remotely created checks (i.e., checks lacking the original signature of the drawer); o Checks drawn on the same account; o Checks that are altered, incomplete, damaged or irregular in any way ( e.g., where the numerical and written amounts are different; checks that are postdated or more than six-months old; o Checks drawn on a foreign bank or payable in a foreign currency; o Checks payable to Cash; o Registered government warrants; o Monetary instruments such as travelers checks, US Savings Bonds, etc.: o Any check that you suspect is fraudulent or not properly authorized; or o Any check or checks that exceed the transaction limitation(s) that we establish from time totime.
Eligible Checks. You agree to scan and deposit only eligible Checks. You agree that you will use the RDC Service only to scan and transmit images of “checks”, as that term is defined in Regulation CC of the Board of Governors of the Federal Reserve System (“Reg CC”), for a deposit to your Account. You agree that the image of any check that is transmitted via the RDC Service shall be deemed an “item” within the meaning of Article 4 of the Uniform Commercial Code (1990 Official Text). You further agree that you will not transmit for deposit any of the following types of Checks or other items which shall be considered prohibited items: o Checks payable to any person or entity other than you o Checks containing an alteration on the front of the Check or item, or which you know or suspect, or should know or suspect, are fraudulent or otherwise not authorized by the owner of the account on which the check is drawn o Checks payable jointly, unless deposited into an account in the name of all payees o Checks previously converted to a substitute check o Checks drawn on a financial institution located outside the United States o Checks that are remotely created checks o Checks not payable in United States currency o Checks dated more than 6 months prior to the date of deposit, or Checks that contain a stamp that voids it after a certain period of time o Postdated Checks o Checks with an improper or missing endorsement o Checks that have previously been submitted through the RDC Service or through a remote deposit capture service offered at any other financial institution o Checks or items that are drawn or otherwise issued by the U.S. Treasury Department o Savings bonds o Checks issued by and drawn on your or your affiliate’s own account(s) o Third party check items (double endorsement check items) o Checks with poor image quality o Checks that are fraudulent or counterfeit o Checks or items prohibited by Avadian’s Membership and Account Agreement, policies, procedures or this Agreement We reserve the right to charge back to your Account at any time, any item that we subsequently determine was not an eligible item. You agree that Avadian is not liable for any loss, costs, or fees you may incur as a result of our charge back of an ineligible item. If you deposit a prohibited Check, you agree to indemnify and reimburse Avadian for, and hold Avadian harmless from and against, any and all losses, costs and expenses (including reasonable attorneys’ fees).
Eligible Checks. You agree to only deposit checks. For purposes of this agreement, a “check” means a negotiable demand draft that is drawn on, or payable through, or at, a United States bank or credit union.

You agree that you will not use the Mobile Deposit Service to deposit any checks as shown below: • Checks payable to any person or entity other than you. • Checks payable to you and another party who is not a joint owner on the Mobile Deposit Authorized Account. • Checks that were drawn by you or any other person or authorized signer on your deposit accounts with us. • Checks containing alteration to any of the fields on the check or item, or which you know or suspect, are fraudulent or otherwise not authorized by the owner of the account on which the check or item is drawn. • Checks previously converted to a substitute check, as defined in Reg CC. • Checks that are remotely created checks, as defined in Reg CC. • Checks drawn on a financial institution located outside the United States or that is not payable in United States Currency. • Checks dated more than six (6) months prior to the date of deposit. • Checks prohibited by the Bank’s current procedures relating to the Mobile Deposit Service or which are otherwise not acceptable under the terms of your Account Agreement. • Checks where the numerical and written amount are different. • Checks that have been previously returned unpaid by the financial institution on which they are drawn. You will not deposit or re-present the original check. • Checks that are payable to cash. Image Quality. The image of a check transmitted to the Bank using the Mobile Deposit Service must consist of legible images of the front and back of the check. The image that is transmitted must be of such quality that the following information can easily be read by sight review of the image: • The amount of the check; • The payee; • The drawer’s signature; • The date of the check, • The check number; • Information identifying the drawer and the paying bank that is preprinted on the check in the MICR line, including the routing transit number, account number, check amount when encoded, serial number, and process control field; • Other information placed on the check prior to the time that the image is captured (such as any required identification or any endorsements applied to the back of the check); and • The image quality of the check must comply with the...
Eligible Checks. The original paper check is referred to as the “Original Check.” The image of the check that you transmit to the Credit Union electronically for deposit is referred to in this agreement as the “Check Image.” “Check” means the Original Check and the Check Image.
