Eligibility of Applicants. 2.2.1 For determining the eligibility of Applicants for their pre-qualification hereunder, the following shall apply: (a) The Applicant for pre-qualification may be a single entity or a group of entities (the “Consortium”), coming together to implement the Project. However, no applicant applying individually or as a member of a Consortium, as the case may be, can be member of another Applicant. The term Applicant used herein would apply to both a single entity and a Consortium. It is also clarified that a „holding company‟ and its „subsidiary (ies)‟ are included within the term Applicant under the form of a „Consortium‟. (b) An Applicant may be a natural person, private entity, government-owned entity or any combination of them with a formal intent to enter into an agreement or under an existing agreement to form a Consortium. A Consortium shall be eligible for consideration subject to the conditions set out in Clause 2.2.6 below. (c) An Applicant shall not have a conflict of interest (the “Conflict of Interest”) that affects the Bidding Process. Any Applicant found to have a Conflict of Interest shall be disqualified. An Applicant shall be deemed to have a Conflict of Interest affecting the Bidding Process, if: (i) the Applicant, its Member or Associate (or any constituent thereof) and any other Applicant, its Member or any Associate thereof (or any constituent thereof) have common controlling shareholders or other ownership interest; provided that this disqualification shall not apply in cases where the direct or indirect shareholding of an Applicant, its Member or an Associate thereof (or any shareholder thereof having a shareholding of more than 5% (five per cent) of the paid up and subscribed share capital of such Applicant, Member or Associate, as the case may be) in the other Applicant, its Member or Associate is less than 5% (five per cent) of the subscribed and paid up equity share capital thereof; provided further that this disqualification shall not apply to any ownership by a bank, insurance company, pension fund or a public financial institution referred to in section 4A of the Companies Act, 1956. Eligibility of Applicants. The potential applicants of this Grant Scheme might be national and local authorities, organisations for nature protection, regional development agencies, tourism and cultural organisations and associations. The people to people actions aim at encouraging and supporting the establishment or further development of sustainable co-operation networks between local and regional stakeholders in the border region in order to increase personnel and institutional capabilities for co-operation and participation in future development programmes. The JSPF supports the establishment and development of cooperative networks on both sides of the border and the creation of linkages between these networks and wider EU networks. The JSPF will promote “soft” cross border activities. The fund will finance selected small-scale “people-to-people” projects. Grants will only be made available for projects whose immediate objective is non-commercial and not-for-profit. Joint projects, especially where co-financed jointly by project partners from Bulgarian and the former Yugoslav Republic of Macedonia, will be particularly encouraged. The following priority themes will be the subject of the call for proposals: • Development or establishment of facilities and resources to improve the flow of information and communication between border regions, including television and radio programmes of common interestCultural exchange • Development or establishment of local employment, education and training initiatives between border regions The project applicants will, in many cases, need considerable development assistance. Training and information workshops may be organised to inform and assist would-be participants, so as to ensure high transparency and encourage good quality proposals. (1) In order to be eligible for a grant, applicant2/cross-border applicant3 must: be legal entity and be non-profit-making organization and be one of the following types of organizations: municipalities, non-governmental organizations; scientific, research, cultural and educational institutions and only in case of Serbian applicants / CB applicants: public utilities bodies, public health institutions, public enterprises, authorities responsible for the nature protection or nature parks management and be national of the Republic of Bulgaria and/or of Republic of Serbia and be registered within an eligible Bulgarian or Serbian district or have registered branch in one of the eligible districts (for more details, please, refer to section 2.1.3) and be registered at least 6 months before the deadline for submission of this Call for proposals {applicable only for Components 2 and 3} and be directly responsible for the preparation and management of the action with their partners, not acting as an intermediary;
