Common use of Eligibility for Investment Clause in Contracts

Eligibility for Investment. 15.1 The Issuer covenants that it will use commercially reasonable best efforts to obtain a letter from the Exchange confirming that the Offered Shares and the Agent’s Warrant Shares will be listed on the Exchange as of the Closing Date (the “Confirmation Letter”).
