Eligibility for funding from the Texas Events Trust Fund KAABOO and ACVB in good faith represent that this Agreement is an “event support contract” as referred to in TAC Rule § 184.23(c), and that the Event forming the basis of this Agreement is eligible for funding from the Texas Events Trust Fund pursuant to Texas law, including TAC Rule § 184.21(a). In no event shall this Agreement require, obligate or compel the Governor’s Office to perform any act not required by law. In this regard, the parties understand that, under TAC Rule § 184.21(a), the Event forming the basis of this Agreement is eligible for participation in the Texas Events Trust Fund program only if: (1) a site selection organization selects a site in Texas for the event to be held one time or, for an event scheduled to be held each year for a period of years under an event support contract, one time each year for the period of years, after considering, through a highly competitive selection process, one or more sites that are not located in this state; (2) a site selection organization selects a site in Texas as: (A) the sole site for the event; or (B) the sole site for the event in a region composed of Texas and one or more adjoining states; and (3) the event will not be held more than once a calendar year in Texas or an adjoining state.
