Electricity Price. The pricing for Electricity shall be the Fixed Price of $______ per kWh for the Initial Term of the Contract. If the Parties agree to Additional Term the Additional Term Fixed Price of $____ per kWh will be used. Electricity price per kWh shall be fully inclusive of the PV System and battery energy storage systems (“XXXX”) as defined in the accompanying SLA, Exhibit C, Technology Description. Contractor shall provide to the Judicial Council all Electricity produced by the PV System at the Electrical Interconnection Point at the Fixed Price per kWh.

Electricity Price. (a). Konarka shall pay Multilayer the Electricity Price (as hereinafter defined) for all Konarka electricity provided by Multilayer pursuant to this Agreement. Multilayer is providing electricity pursuant to this Agreement solely because it is not currently able to cause the Facility to be separately metered so that Konarka is billed directly by the utility. Electricity supplied hereunder is obtained by Konarka directly from the electrical grid and the applicable utility companies serving the New Bedford area. It is the parties' intent to pass through to Konarka all costs charged by the applicable utility companies to provide electricity from the grid. Accordingly, the parties agree that the Electricity Price is intended to produce a cost for electricity that Konarka would otherwise have paid to the electric utility under the tariff then in effect, if it were not receiving electricity from Multilayer pursuant to this Agreement. For purposes of calculating the Electricity Price, there is a submeter serving the Facility which monitors actual electricity useage for the Facility.

Accordingly, the parties agree that the Electricity Price is intended to produce a cost for electricity that Multilayer would otherwise have paid to the electric utility under the tariff then in effect, if it were not receiving electricity from Lxxxxxx pursuant to this Agreement. Lxxxxxx shall use reasonable efforts to obtain electricity service from the utility suppliers at the lowest commercially reasonable cost. For purposes of calculating the Electricity Price, there is a submeter serving the Multilayer Property which monitors actual electricity useage for the Multilayer Property.

Electricity Price. From and after the Commercial Operation Date, in consideration of the delivery of Electric Output from the System and the installation and transfer of the Diesel Generator, Customer shall pay Seller monthly for the Electric Output delivered to the Delivery Points, at the $/kWh rate shown in Exhibit C (the “Electricity Price”). The monthly payment for Electric Output will be equal to the applicable $/kWh rate multiplied by the number of kWh of Electric Output generated during the applicable month, as measured by the System Meters. Seller shall invoice Customer monthly for Electric Output, either manually or through ACH. Such monthly invoices shall state (i) the amount of Electric Output produced by the System and delivered to the Delivery Points, (ii) the Electricity Price payable by Customer under this Agreement for such Electric Output, as provided on Exhibit C, (iii) applicable taxes and charges payable by Customer for the month as provided in this Agreement, and (iv) the total amount due from Customer for Electric Output.

Electricity Price. As the discussion related to the nature of the obligation, the quantity measured will complete the needed determination for the transfer to take place. The art. 245.º of the RRC states the quantities to be measured or determined (for the purpose of applying the tariffs) are as follows: power load, contracted power, power at peak hours, active energy and reactive energy. The art. 256.º adds that the power taken is the highest value of the average active power, recorded in any uninterrupted period of 15 minutes, during the interval of time that the invoice respects. This corresponds to the variable part of the price, that can either be set a minimum quantity (still here the price would be related to availability rather than delivery). This may also be the object of adjustment (usually inflation or another agreed index). Namely, when discussing curtailment and its compensation, the argument is on the payment for availability or the undelivered output or the possibility to make third-party sales (resource is not wasted, not used but sold to a third party if the purchaser agrees with such terms).

Therefore, under the hypothesis of a continuous hydrogen production, 24 hours a day, the average electricity price for a hydrogen producer by electrolysis is a weighted average of the base and peak prices of the market corresponding to the considered country. These electricity prices thus calculated constitute the observations of our explained variable (pe). The observations for the carbon prices are front-year prices18 from ICE Endex19. The ordinary least squares estimate results are available in appendixA. We summarize here the final results.
