ELECTRIC SERVICE AGREEMENT. PEAK-CONTROLLED (Continued) Section No. 7 1st Revised Sheet No. 7 A trial period for Peak-Controlled Service or Peak-Controlled Time of Day Service will not be available to any customer account that has previously received either service. Customer will pay a cancellation charge after the twelve month trial period if Customer terminates this agreement and chooses to receive electric service from NSP on a non-interruptible basis or this agreement is terminated as a result of any default of Customer. Customers who choose to terminate this contract and choose not to receive firm or higher priority service from NSP for the controllable load specified in this agreement will not be assessed the cancellation charge. The cancellation charge will be the difference between the billing amounts described above for the most recent 18 months of Peak-Controlled Service or Peak-Controlled Time of Day Service. Customer will not receive a refund for additional charges which were assessed during this 18 month period due to customer failure to control load. Additionally if at any time this agreement is terminated in any above described manner, Customer will be charged all installation and removal costs for special equipment and facilities provided by Company for Peak- Controlled Service or Peak-Controlled Time of Day Service.
ELECTRIC SERVICE AGREEMENT. If the IPP requires black-start capability or station service from BC Hydro in the event of a plant outage, an “Electric Service Agreement” (ESA) for service under the Electric Tariff Rate Schedule 1853 will need to be signed prior to executing the EPA. If there is an existing ESA for the Seller’s Plant, it may need to be amended or replaced to be consistent with current standards. See Schedule G for a sample form of the ESA.
ELECTRIC SERVICE AGREEMENT. Kenergy covenants that: It will at all times fully perform and discharge all of its obligations under the Electric Service Agreement; It will not resell any Electric Services purchased from Big Rivers under this Agreement, except as expressly permitted in this Agreement and the Electric Service Agreement or with the prior written consent of Big Rivers, in Big Rivers' sole discretion and it shall require that any Energy that Kenergy purchases from Big Rivers under this Agreement and resells to Century under the Electric Service Agreement must be consumed by Century in connection with its operation of the Hawesville Smelter;
