Common use of Election of Remedies and Waiver Clause in Contracts

Election of Remedies and Waiver. After a grievance has been submitted to arbitration, the grievant and the Association waive any right to pursue against the District an action or complaint that seeks the same remedy. If a grievance or the Association file a complaint or other action against the District, arbitration seeking the same remedy may not be filed or pursued.
