Effective Date; Term. This Agreement shall become effective on the date set forth on the first page of this Agreement. Subsequent to this initial period of effectiveness, 2008, this Agreement shall continue in full force and thereafter effect only so long as its continuance has been specifically approved at least annually in accordance with Sections 15(a) and (c) by the Trustees, or the shareholders of the 1940 Fund in the manner required by the Act. The aforesaid requirement shall be construed in a manner consistent with the Act and the Rules promulgated rules and regulations thereunder. 24.
