Common use of EFFECTIVE DATE OF SETTLEMENT Clause in Contracts

EFFECTIVE DATE OF SETTLEMENT. Settlements reached at any step of the grievance procedure may be applied retroactively to the date of the occurrence of the situation which gave rise to the grievance or the settlement may be applied in a different manner which is consistent with the intent of Clause 74.12.

EFFECTIVE DATE OF SETTLEMENT. Settlements reached at any step of the grievance procedure may in this Article shall be applied retroactively so as to rectify the date of the occurrence of the action or situation which gave rise to the grievance grievance, but shall not be made retroactive prior to the effective date of the Agreement in effect at the time of the occurrence or the settlement may be applied in a different manner which is consistent with the intent of Clause 74.12date set by an arbitrator.
