Effect of Discontinuance of Proceedings. In case any action taken by the Trustee on account of any default hereunder shall have been discontinued or abandoned for any reason, then and in every such case the Corporation, the Trustee and the Owners shall be restored to their former positions and rights hereunder, respectively, and all rights, remedies, powers and duties of the Trustee shall continue as though no such action had been taken.

In case any proceeding taken by the Trustee on account of any default shall have been discontinued or abandoned for any reason, then, and in every such case, the Authority, the Trustee, the Guarantor, the Borrower and the Bondholders shall be restored to their former positions and rights hereunder, respectively, and all rights, remedies, powers and duties of the Trustee shall continue as though no proceeding had been taken.

In case the Mortgagee shall have proceeded to enforce any right under the Mortgage by foreclosure, sale, entry or otherwise, and such proceedings shall have been discontinued through written notice to the Company by the Mortgagee or shall have been determined adversely, then and in every such case the Company and the Mortgagee shall be restored to its position and rights hereunder as they existed immediately prior to the commencement of such proceedings with respect to the property subject to the Lien and security interest of this Mortgage.

In case any proceeding taken by the Trustee or the Letter of Credit Issuer on account of any default shall have been discontinued or abandoned for any reason, then, and in every such case, the Authority, the Trustee, the Letter of Credit Issuer, the Borrower and the Bondholders shall be restored to their former positions and rights hereunder, respectively, and all rights, remedies, powers and duties of the Trustee and the Letter of Credit Issuer shall continue as though no proceeding had been taken.

In case any proceedings taken by the Mortgagee on account of any Event of Default hereunder shall have been discontinued or abandoned for any reason, or shall have been determined adversely to the Mortgagee, then and in every such case, the Debtor, the Mortgagee and the Holders of the Bonds shall be restored, respectively, to their former positions and rights hereunder, and all rights, remedies, powers and duties of the Mortgagee shall continue as in effect prior to the commencement of such proceedings.
Effect of Discontinuance of Proceedings. In case the Indenture Trustees (or the Security Trustee on behalf of the Indenture Trustees) shall have proceeded to enforce any right under this Deed of Trust by foreclosure, sale, entry or otherwise, and such proceedings shall have been discontinued or abandoned for any reason or shall have been determined adversely, than and in every such case the Grantor and the Indenture Trustees (or the Security Trustee on behalf of the Indenture Trustees) shall be restored to their position and rights hereunder as they existed immediately prior to the commencement of such proceedings with respect to the property subject to the lien of this Deed of Trust.

If any proceeding taken by the Trustee or Owners of Bonds on account of any Event of Default is discontinued or abandoned for any reason, then and in every such case, the City, the Trustee and the Owners of Bonds shall be restored to their former positions and rights hereunder, and all rights, remedies, powers and duties of the Trustee shall continue as though no proceedings had been taken.
