Effect of Article. Employees whose conduct does not conform to the rules and guidelines contained in this Article may be subject to disciplinary action, up to and including termination. Effect of Article a) The following provisions shall apply to the administrative investigation of alleged misconduct by APD Police Officers and the process of administrative discipline. Effect of Article. Any purported Transfer of Partnership Interest consummated in violation of this Article shall be null and void and of no force or effect. Any transferee acquiring an interest in the Partnership shall acquire the same subject to all the terms and provisions of this Agreement.

Cause: Discipline shall be imposed on Bargaining Unit Members only for just cause as determined by law and/or prescribed in the SVUSD Personnel Commission Rules (Merit System Rules), and only pursuant to the procedures outlined herein, (see Appendix D: MS Rule 6.70 - Disciplinary Action and Appeal). Disciplinary action is deemed to be any action which deprives any Bargaining Unit Member of any classification or incident of employment of classification in which the Bargaining Unit Member has permanent status and includes but is not limited to: dismissal, demotion, suspension, written reprimand, or any type of derogatory material placed into a Bargaining Unit Member’s personnel file. Progressive Discipline: Prior to imposing formal disciplinary action against a Bargaining Unit Member, the District shall follow the principles of progressive discipline consisting of: oral warnings, written warnings, written reprimands, suspension, and termination. The District maintains the right to skip steps of progressive discipline in cases where the safety of District employees, students or the public might be in question, or in cases of theft or intentional damage to District property or willful violations of law. Step One: Oral Warning Prior to any formal disciplinary action, the Bargaining Unit Member shall be orally notified by his/her immediate supervisor that a deficiency in his/her job performance has been observed. At this informal meeting, the Unit Member shall be informed of the specific areas of his/her service which need improvement and, where appropriate, the supervisor shall prepare a plan for assistance which will help the employee correct any deficiencies and provide for a time period for improvement. This shall be an informal meeting and no record shall be included in the employee’s permanent personnel file of this meeting at this time, however may be documented for the supervisor’s site file.
