EARNED ROYALTIES AND MINIMUM ANNUAL ROYALTIES. 9.1 The Licensee will also pay to TRD an earned royalty on the Net Sales of each Licensed Product, Licensed Method or Licensed Service by the Licensee or any Affiliate or Joint Venture as provided for in Paragraphs 9.2 and 9.3 below (“Royalty”).
EARNED ROYALTIES AND MINIMUM ANNUAL ROYALTIES. 8.1 The Licensee will also pay to The Regents an earned royalty of (i) four percent (4%) of the Net Sales of Licensed Product or Licensed Method by the Licensee or any Affiliate or Joint Venture; and (ii) four percent (4%) of any Service Income of the Licensee, any Affiliate or Joint Venture ("Royalty"). For clarity, these earned royalties and other provisions related thereto under this Article 8 include and apply to, without limitation, such Net Sales of Licensed Product or Licensed Method and Service Income received by Licensee from any Customer Sublicensee ("Customer Sublicensee Royalty").
