Early Cancellation Fee in respect of any Agreement for a Fixed Term terminated before the Expiry Date, a sum payable by the Customer to GO Power calculated as follows: the daily average of the Charges paid by the Customer in respect of the Supplier Management Sum (as detailed on the Energy Supply Contract, or varied in accordance with this Agreement from time to time) in the 3 months preceding date of notice of termination multiplied by the Early Cancellation Period.

The amount of your Early Cancellation Fee is defined in your Service Agreement. The Early Cancellation Fee must be provided within five (5) business days from our receipt of your written notice of early cancellation. No early cancellation of a Service Agreement will take effect until the Early Cancellation Fee has been paid, and you will continue to be billed monthly until we receive both proper written notice of cancellation and the early cancellation fee, as applicable. Upon execution of this agreement, Marketing 360® will be investing considerable work into Client’s business and online marketing activities. This investment is being made with the understanding that you are committing to pay for the Services through the Initial Term. Client recognizes the aforementioned investment, up-front sales, setup and opportunity costs that Marketing 360® bears in connection with this marketing commitment, and acknowledges that this fee is not a penalty, but rather a reasonable amount of liquidated damages to compensate Marketing 360® for early cancellation of the Services.

Early Cancellation Fee. 12.1 The Early Cancellation Fee (ECF) is not a penalty, but rather a charge to compensate us for your failure to satisfy the contract term on which your service fees are based. The ECF shall be calculated as twenty (20) percent of the sum of the fee for services provided times the number of service periods remaining on the term specified in the contract.

If you are subject to a 12 month commitment, the maximum fee is $240 for customers with standard, DVR, HD and/or HD-DVR boxes. If you are subject to a 24 month commitment, the maximum fee is $480 for customers with standard, DVR, HD and/or HD-DVR boxes. We prorate the fee, so for each month you’ve fulfilled your programming term agreement, we deduct $20 from the fee (i.e., if you have fulfilled 14 mos. of a 24 mo. agreement, your ECF would be $480 - $20 x 14, or $200). We reserve the right to charge this fee to the credit or debit card you have on file with us. We do not charge an ECF if you decide to cancel your DVR Service or HD Access early, so long as you maintain the base level of programming. However, upon cancellation of DVR Service and/or HD Access, you are required to return the equipment used in connection with these services to DIRECTV as described in Part Two below. PART TWO:

Upon cancellation of IPTV Services, you are required to return the equipment used in connection with these services to Southern Montana Telephone Company. If equipment is not returned to SMTC within 30 days of cancelation you will be charged for your equipment. Equipment reimbursement is $150.00 for each standard STB and $300.00 for each PVR STB not returned.
