Common use of Duplication of Benefits Clause in Contracts

Duplication of Benefits. Boeing and Customer agree that it is not the intent of the parties under this Letter Agreement to cause Boeing and/or Engine Manufacturer to provide duplicate benefits to Customer for the same event which results in Customer’s unjust enrichment, provided that, in the case of any such duplicate benefits, Customer shall be entitled to elect to receive the benefit which is most favorable to Customer.

Duplication of Benefits. Boeing and Customer agree that it is not the intent of the parties under this Letter Agreement to cause Boeing and/or Engine Manufacturer to provide duplicate benefits hereunder in addition to the benefits to be provided under the Purchase Agreement, and any direct commitment to Customer for by the same event which results in Customer’s unjust enrichment, provided that, in the case of any such duplicate benefits, Customer shall be entitled to elect to receive the benefit which is most favorable to Customerengine manufacturer.

Boeing and Customer agree that it is not the intent of the parties under this Letter Agreement to cause Boeing and/or Engine Manufacturer to provide benefits hereunder that duplicate benefits to Customer for be provided (a) by Boeing under the same event which results in Purchase Agreement, or any other agreement between Boeing and Customer’s unjust enrichment, provided thator (b) by engine manufacturer under any agreement between engine manufacturer and Customer, in due to the case of any such duplicate benefits, Customer shall be entitled to elect to receive the benefit which is most favorable to CustomerAircraft [***].

Boeing and Customer Buyer agree that it is not the intent of the parties under this Letter Agreement to cause Boeing and/or Engine Manufacturer to provide duplicate benefits to Customer Buyer for the same event which results in CustomerBuyer’s unjust enrichment, provided that, in the case of any such duplicate benefits, Customer Buyer shall be entitled to elect to receive the benefit which is most favorable to CustomerBuyer.
