Dues Deductions. The District will deduct Association dues from the pay of bargaining unit employees who authorize such deductions in writing pursuant to RCW 41.56.110. Dues Deductions. Prior Section 6.1. As a condition of continued employment with the City of Newark, Department of Public Safety, Division of Police, all employees of the bargaining unit who are not members of the employee organization (Union) shall pay to the preparation Union, as hereinafter provided, a fair share fee. This provision shall not be interpreted to require any employee to become a member of the first payroll Union; nor shall fair share fees exceed dues paid by members of the school yearemployee organization who are in the same bargaining unit. Union agrees to prescribe an internal procedure to determine a rebate, if any, for non- members which conforms to Federal Law, for those occasions where a non-member makes a timely demand upon the Union. Absent arbitrary and capricious action, such determination is conclusive on the parties except that a challenge to such determination may be filed with the State Employment Relations Board within thirty (30) days of the determination date specifying the arbitrary or capricious nature of the determination and the State Employment Relations Board shall review the rebate determination and decide whether it was arbitrary or capricious. The deduction of a fair share fee by the Employer from the payroll check of the employee and its payment to Union is automatic and does not require the written authorization of the employee. The internal rebate procedure shall provide for a rebate of expenditures in support of partisan politics or ideological causes not germane to the work of employee organization in the realm of collective bargaining. Any public employee who is member of and adheres to established and traditional tenets or teachings of a bona fide religion or religious body which has historically held conscientious objections to joining or financially supporting an employee organization and which is exempt from taxation under the provisions of the Internal Revenue Code shall not be required to join or financially support any employee organization as a condition of employment. Upon submission of proper proof of religious conviction to the State Employment Relations Board, the Association Board shall indicate declare the employee from becoming a member of or financially supporting an employee organization. Prior Dues for the SCEA, ETEA, TEA, NEA, Xxxxxxxx County Vocational Association, Tennessee Vocational Association and American Vocational Association shall be deducted from the employee's salary in ten equal installments from September through June. Prior The Employer agrees to deduct Union dues or comparable service fees for the preparation employees electing not to become Union members, from the wages of the first payroll of employees who voluntarily provide the school year, the Association shall indicate to the District, in writing, the dollar amounts of individual dues and assessments of the Southside Education Association, National Education Association, Washington Education Association and Olympic UniServ Council, to be deducted during the school year to follow. These total deductions shall remain unchanged during the school year. The deductions, as indicated above, shall be deducted in twelve (12) equal amounts in paychecks to begin in September and continue through August; provided that the District has received Employer with a written authorization form from any such employee who desires to make said such deductions; teachers who work less . The written authorization shall be irrevocable for a period of more than a full one (1) year or beyond the termination date of this Agreement, whichever occurs sooner. Deductions shall have their deductions pro-rated at one- twelfth be made from the wages of employees in the first (1/12th), 1st) pay period of the total month following the actual withholding, together with a record of the amount, social security number, and name of those for each month they are employed. Amounts may be prorated by the amount of FTE worked as agreed upon and presented in writing by the Southside Education Association. The District shall promptly remit all monies so collected directly to the Washington Education Association with a list of teachers from whom such deductions have been made. The District shall notify Employer will work with the Association of any Union to implement changes in said list due dues and fees deductions in a reasonable time after the notification of such changes. The Union agrees to teachers entering refund promptly any dues found to have been improperly deducted and transmitted to the union. Any employee who is paying dues or leaving an amount equal to dues may stop making those payments by giving written notice to both the employment Employer and the Union during the period not less than thirty (30) and not more than forty-five (45) days before the annual anniversary date of the District; employee’s authorization or the date of termination of the applicable contract between the Employer and the Union, whichever occurs sooner. The Employer will honor employee check-off authorizations unless they are revoked in writing during the window period, irrespective of the employee’s membership in the Union. The Union will provide to the Employer verification that dues deductions have been authorized by the employee. Employees may express such notification shall be before authorizations by submitting to the monthly pay periodUnion a written application form, through electronically recorded phone calls, by submitting to the Union an online deduction authorization, or by any other means of indicating agreement allowable under state and federal law. The Union will also send copies to the Employer of the various warning notices sent to the member pursuant to its present practice so that the Employer may take steps designed to keep the Employee in good standing. If the Association receives an amount for a teacher Employee does not remain in excess of the proper amount to be deductedgood standing, as defined above, the Association Employer shall reimburse that teacher for any overcharge in dues. The Association will indemnify, defend and hold terminate the District harmless against any claims, suits, orders, and/or judgments against the District on account Employee within three (3) days of any check-off of Association dues. This dues deduction system is only for the collection of dues and shall not be used for the collection of any Association imposed fines, penalties, or assessments, nor will it be used for the collection of initiation fees or any other type of Association collection of monies. Employees who wish to revoke this deduction authorization may do so upon written notice to the District and the Association. The employee shall provide written notice to the Association and to the District of his/her wish to no longer have dues withheld from his/her paycheck. Teachers who decide to join the Association and currently have no deductions for dues may do so by signing and delivering, by from the fifteenth of any month, a payroll deduction or revocation authorization form to the District office. This form shall authorize deduction of membership dues of the Associations (including NEA and WEA) and shall continue in force from year to year unless the teacher submits a written revocation to the District and the AssociationUnion.

Dues Deductions. Prior Section 6.1. As a condition of continued employment with the City of Newark, Department of Public Safety, Division of Police, and commencing on the completion of a one (1) year probationary period, all employees of the bargaining unit who are not members of the employee organization (Union) shall pay to the preparation Union, as hereinafter provided, a fair share fee. This provision shall not be interpreted to require any employee to become a member of the first payroll Union; nor shall fair share fees exceed dues paid by members of the school yearemployee organization who are in the same bargaining unit. Union agrees to prescribe an internal procedure to determine a rebate, if any, for non- members which conforms to Federal Law, for those occasions where a non-member makes a timely demand upon the Union. Absent arbitrary and capricious action, such determination is conclusive on the parties except that a challenge to such determination may be filed with the State Employment Relations Board within thirty (30) days of the determination date specifying the arbitrary or capricious nature of the determination and the State Employment Relations Board shall review the rebate determination and decide whether it was arbitrary or capricious. The deduction of a fair share fee by the Employer from the payroll check of the employee and its payment to Union is automatic and does not require the written authorization of the employee. The internal rebate procedure shall provide for a rebate of expenditures in support of partisan politics or ideological causes not germane to the work of employee organization in the realm of collective bargaining. Any public employee who is member of and adheres to established and traditional tenets or teachings of a bona fide religion or religious body which has historically held conscientious objections to joining or financially supporting an employee organization and which is exempt from taxation under the provisions of the Internal Revenue Code shall not be required to join or financially support any employee organization as a condition of employment. Upon submission of proper proof of religious conviction to the State Employment Relations Board, the Association Board shall indicate declare the employee from becoming a member of or financially supporting an employee organization. The employee shall be required, in lieu of the fair share fee, to pay an amount of money equal to such fair share fee to a non-religious charitable fund exempt from taxation under Section 501(C)(3) of the Internal Revenue Code mutually agreed upon by the employee and the Union's Financial Secretary. The employee shall furnish to the Districtemployee organization written receipts evidencing such payment, and failure to make such payment or furnish such receipts shall subject the employee to the same sanctions as would non-payment of dues under this Agreement. It is agreed that the Union shall indemnify and hold harmless the City from any and all claims, demands, and expenses incurred in writingthe defense against such claims and demands, made by an employee in the bargaining unit against the City as a result of the Union's establishment or an amount which it considers to be a fair share fee and/or Union dues and the Union's management of the rebate procedure. The Administration will transmit the dues monthly to UA-UNM. The Union shall indemnify, pay for the defense of, and save the Administration harmless against any and all claims, demands, suits, or other forms of liability that shall arise out of or as a result of any conduct taken by the Administration for the purpose of complying with this Article. Solicitation of membership shall not interfere with the instruction of students or the delivery of services. The membership card, which shall include the employee’s Banner ID and NetID, is attached hereto in Appendix A, and may be amended by the Union.
