Distribution of Enrollment Materials. Contractor agrees to distribute to effectuated or pending enrollees on and off-exchange the Open Enrollment publications developed and printed by Covered California for Enrollees prior to the Open Enrollment Period at a time mutually agreed to by the Contractor and Covered California. Contractor shall be responsible for the mailing cost associated with these publications.

The Client shall, if applicable, deliver to each Prospective Cardholder who enrolls in a Program a set of instructional materials (the “Enrollment Materials”) for the Program in which the Prospective Cardholder elects to participate. The Enrollment Materials may include, without limitation, the Cardholder Agreement, which includes the Cardholder Services Fee Schedule (as defined below), a Card, A direct Deposit Authorization Form and other materials as required.

You will distribute any pre-enrollment materials that we provide to you to each potential enrollee before collecting enrollment applications. Nothing in this Section will preclude you from making additional disclosures about your group health benefit plan as applicable to comply with ERISA, such as a wrap-around summary plan description or other plan document. If applicable, you are solely responsible for compliance with ERISA disclosure requirements in connection with the Medicare Plan(s).

Distribution of Enrollment Materials. CMS modifies the timeframe for the distribution of materials to new enrollees to require the Card Sponsor (a Medicare cost contractor) to provide the materials within 14 and 30 days of the Card Sponsor’s receipt eligibility reply from CMS.
