Disqualification of Bidder. An employee who is unable to perform the job to which he bid to the satisfaction of the Company within sixty-four (64) work days after being awarded the job shall be returned to the job classification the employee held at the time of submitting the bid. An employee so returned shall not be eligible to bid again for the same job from which the employee returned for a period of twelve (12) months.

Disqualification of Bidder. Bidders may be disqualified from bidding for failure to comply with the requirements of this Special Provision, the Contract specifications, and VDOT Road and Bridge Specifications.

Disqualification of Bidder. A Bidder offering products/services to the Municipality of Kincardine certifies that it has not communicated directly or indirectly their bid to any competitor or any other person engaged in such line of business. Any or all bids may be rejected if Municipality of Kincardine believes that collusion exists among the Bidders. Bids in which the prices are obviously unbalanced may be rejected.
Disqualification of Bidder. If there is reason to believe that collusion exists among the bidders, the City of Milpitas may refuse to consider bids from participants in such collusion. No person, firm, or corporation under the same or different name, shall make, file, or be interested in more than one bid for the same work unless alternate bids are called for. A person, firm, or corporation who has submitted a sub-Bid to a bidder, or who has quoted prices on materials to a bidder, is not thereby disqualified from submitting a sub-bid or quoting prices to other bidders. The value of the project is estimated to be in the range of One Hundred Thousand Dollars and Zero Cents ($100,000.00) per year. This esimated amount is not a guarantee of work. It is only an estimate based on historical usage. EXPERIENCE AND COMPETENCY. The Successful Bidder shall be skilled and regularly engaged in the general class or type of work called for under the contract. The Successful Bidder shall also have no less than five (5) years of experience in the magnitude and character of the work bid. Each Bidder shall be set forth their experience on the form entitled Bidder’s Experience and submit it with their bid. It is the intention of the City of Milpitas to award a contract to a Bidder who furnishes satisfactory evidence that they possess the requisite experience, ability, sufficient capital, and facilities to enable themselves to prosecute the work successfully and properly and to complete it within the time specified in the contract. To determine the degree of responsibility to be credited to the Bidder, the City of Milpitas will weigh any evidence that the Bidder has performed satisfactorily other contracts of like nature, magnitude, and comparable difficulty and comparable rates of progress. In selecting the lowest responsive and responsible Bidder, consideration will be given to the general competency of the Bidder for the performance of the work specified in the contract documents.
