Disposition of Materials. All materials submitted in response to the RFP will become the property of the JBE and will be returned only at the JBE’s option and at the expense of the Proposer submitting the proposal. PAYMENT
Disposition of Materials. Upon the expiration or earlier termination of this Agreement, or earlier if requested, all residual amounts of Materials provided to RMS by Pharmaceutical Partners shall be returned to Pharmaceutical Partners upon their request within [**] days of such notice of request, except to the extent necessary or appropriate as required for verification to any Regulatory Authority for any activities conducted under the Project Plan. For any Materials provided to RMS by or on behalf of Pharmaceutical Partners and sent to Contract Laboratories or which were directly sent to Contract Laboratories, RMS agrees to assist in arranging for the return of such Materials within [**] days of such notice of request. Such request shall include instructions on where and how such Materials are to be returned to Pharmaceutical Partners, at Pharmaceutical Partners’ expense. Without limiting the foregoing, if Pharmaceutical Partners terminate this Agreement pursuant to Section 15.5 or Section 15.6, RMS shall provide Pharmaceutical Partners with [**]. If Pharmaceutical Partners terminate this Agreement pursuant to Section 15.5 or Section 15.6, RMS agrees to make Assay Performance Data generated prior to the date of such termination available to the extent required by Pharmaceutical Partners to exercise its license rights under Section 9.7.
Disposition of Materials. Any and all trash removed and not reused in the construction, shall be disposed of by Tenant as waste or unwanted material to a construction dumpster located in the Loading Dock. The dumpster shall be provided by Tenant at its cost. The building compactor is not to be used by any of the Tenant’s contractors. Violations will result in a charge to the Tenant.
Disposition of Materials. Upon termination or completion of all Work under the Contract, the CMA shall dispose of all excess materials and debris it produced during the performance of the Contract as directed by APS, or as specified in other provisions of the Contract Documents. All materials produced or required to be delivered under the Contract become and remain the property of APS at the time of their creation or delivery.

Any and all unused construction materials shall be disposed of by the General Contractor in the same manner as waste or unwanted material, except as may otherwise be directed by Landlord. General Contractor shall not use the building trash compactor. The placement of a container or vehicle in which to empty trash must be scheduled through the management office. The General Contractor is responsible for keeping the area around the trash container clean at all times.

Promptly upon written request by the Owner at any time, or upon the earlier determination by the Receiving Party of its lack of interest in entering into a written contractual relationship with the Owner (the “Inquiry Period”), the Receiving Party will return all Confidential Information and Material in its possession in tangible form, whether originated by the Owner or the Receiving Party, to the Owner without retaining copies, extracts, or other reproductions thereof in whole or in part. At the end of the Inquiry Period, all reports or copies of Confidential Information and Material which may be stored on any devices which are part of the Receiving Party’s computers, tablets, mobile phones, servers, or are part of mass storage containing primarily other material, whether created for back-up or other purposes, shall be written over or otherwise expunged from such devices so they cannot be restored.
Disposition of Materials. Promptly after the Effective Date of Termination or the expiration of this Agreement, Xxxxxxxx shall return to NGS any and all materials furnished hereunder to Xxxxxxxx by NGS, and shall promptly dispose of, by delivery to NGS or by destruction, at NGS’ option, and [*] to NGS, all advertising, promotional matter and other written materials bearing the Licensed Property which are then in its possession or subject to its control (other than Xxxxxxxx’x own file copies).

However, to the extent that UCB retains a Commercial License to one or more Licensed Proteins after the Termination Date, UCB may retain any Materials received from FivePrime that are within the scope of such continuing license.
