Dismissal of Complaint. 59. The Office agrees that if the Company is in full compliance with all of its obligations under this DPA, the Office, within ten (10) calendar days of the expiration of the term of this DPA, will seek dismissal with prejudice of the criminal complaint described in paragraph 2 above. Except as otherwise provided herein, during and upon the conclusion of the term of this DPA, the Office agrees that it will not prosecute the Company further for the matters that have been the subject of the Office’s investigation relating to this DPA, including but not limited to Payments that the Company made to Consultants between 2002 and 2006.
Dismissal of Complaint. If the inves- tigation reveals no violation of this part, the responsible civil rights offi- cial will dismiss the complaint and no- tify the complainant and recipient.
Dismissal of Complaint. Within five (5) days of the Effective Date, MyGo shall dismiss the Action against Xxxxxxx without prejudice, with each party to bear its own fees and costs, but within nine (9) months of the Effective Date, the dismissal shall be with prejudice.
Dismissal of Complaint. 34. Within 3 business days after receipt of the Payment, the FHCCI shall voluntarily dismiss the First Amended Complaint with prejudice by filing a notice of dismissal with prejudice in accordance with Federal Rule of Civil Procedure 41(a)(1)(A)(i).

Upon final approval of this Agreement, the parties will jointly move the Court to enter an order dismissing all issues, claims, and causes of action arising from plaintiffs' Complaint, other than otherwise provided for in this Agreement. This Agreement will not become effective until the Court signs such an order.
Dismissal of Complaint. Within five (5) business days after this Agreement is signed by the Parties following approval by ordinance by the San Francisco Board of Supervisors and Mayor, the City and County of San Francisco agrees to file a Notice of Dismissal pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(i) to dismiss their lawsuit described in Recitals Paragraphs J above, Case No. 3:22-CV-4500, currently pending in the Northern District of California. The Notice of Dismissal shall dismiss the case with prejudice, including all claims asserted or that could have been asserted in that action. The Notice of Dismissal shall also provide that each party will bear their own attorney’s fees, costs, and expenses.
Dismissal of Complaint. Xxxxx shall, upon receipt of consideration set forth in Paragraph 4 hereof, cause the Complaint heretofore filed with the United States District Court, Central District of Illinois, Case No. 2:17-cv-02241-CSB-EIL, to be dismissed, with prejudice. Each party shall be responsible for her or its own attorney’s fees and costs.
Dismissal of Complaint. Bard shall, promptly following the Effective Date, take such action, including filing such documents, as required by the Court in order to dismiss the Complaint with prejudice.
Dismissal of Complaint. On April 29, 2003, Licensee filed in the Maricopa County Superior Court a Verified Complaint ("Complaint") captioned Yp.Net, Inc v. Onramx Xxxxss, Inc., cause no. CV 2003-008232, asserting a right to the Domain Name. Upon execution of this Agreement, the Complaint shall be dismissed with prejudice in the form of Notice Of Voluntary Dismissal With Prejudice appended hereto.
Dismissal of Complaint. Within two business days of confirmation that VM Group has completed the actions required in Section 1(a) of this Agreement and the Voting Agreement has been executed and delivered by the VM Group, Medbox agrees to files a dismissal in the form attached hereto as Exhibit B.
