Discretionary Unpaid Leave. A permanent employee may request an unpaid discretionary leave of absence by submitting a written request to the Executive Director stating the reason for the leave and the proposed duration. Leaves may be granted at the discretion of the Executive Director. If a discretionary leave is granted, a date shall be set for the end of the leave, and the employee shall have a right to return to employment on that date. If the employee's position is vacant, he or she may return on a date earlier than the established ending date provided prior approval of the Executive Director has been received. Absent good cause, a permanent employee who does not return from a discretionary leave on the specified date and has not received the written approval of the Executive Director for an extension of leave shall be deemed to have resigned effective the day following the employee's scheduled return. The layoff and recall provisions of this Agreement shall apply to permanent employees on discretionary leave. When the leave of absence is not due to disability, fringe benefits such as health, dental and life insurance will continue for sixty days, after which they are terminated until the beginning of the month in which the employee returns to work. Employees will not accrue additional vacation or sick leave while on leave. Health plan, life, dental or disability contributions ordinarily made by the Employer beyond the last day of the first month of leave may be made by the employee at his or her own expense to the extent-permitted by the applicable plan and by federal law, COBRA.

Discretionary Unpaid Leave. 12 A member may not take unpaid leave without the Superintendent’s permission 13 and permission shall not be granted if the member has any personal and/or vacation leave 14 time remaining. If the member has no remaining leave time, the Superintendent may grant 15 no more than three unpaid leave days.
