Common use of DISADVANTAGED BUSINESS ENTERPRISE PROVISIONS Clause in Contracts

DISADVANTAGED BUSINESS ENTERPRISE PROVISIONS. The Construction Manager shall include the provisions of paragraphs (34.1) through (34.6) in every subagreement, including procurements of materials and leases of equipment, unless exempt by the Regulations or directives issued pursuant thereto. The Construction Manager will take such action with respect to any Subcontractor or procurement as the State Department of Transportation or any Federal funding agency may direct as a means of enforcing such provisions including sanctions for noncompliance: Provided, however, that in the event a Construction Manager becomes involved in, or is threatened with, litigation with a Subcontractor or supplier as a result of such direction, the Construction Manager may request the State Department of Transportation to enter into such litigation to protect the interest of the State, and, in addition, the Construction Manager may request the United States to enter into such litigation to protect the interests of the United States.
