Common use of Disabled Employees' Preference Clause in Contracts

Disabled Employees' Preference. An employee who has been permanently incapacitated at work by injury or compensable occupation disablement, and is unable to perform his/her regular duties to the satisfaction of the Employer, will be employed in other work which he/she can do providing a suitable position is available and the applicable rate for the new position will apply. Such employee shall not displace an employee with more seniority. An employee displaced as a result of this Clause shall have the right to bump the least senior employee provided he/she is qualified and able to perform the work required.
