Disability Illness. If Employee is unable to perform his duties (as described in paragraph number 2, as a result of illness and such illness continues for more than thirty (30) days, SteelCloud may terminate Employee's employment, and/or modify this Agreement with regard to Employee's compensation and duties.

Disability Illness. Employee shall be paid his full Base Salary for any period of his illness or incapacity provided that such illness or incapacity does not render Employee unable to perform his duties under this Agreement for a period longer than three consecutive months. At the end of such three-month period, the Bank may terminate Employee's employment and this Agreement. If the Bank terminates this Agreement, due to Employee's disability, the Bank shall pay to Employee as a disability payment, an amount equal to 100% of Employee's monthly Base Salary for the first three months and 70% thereafter for the remainder of the term of this Agreement. The disability payment shall be payable in accordance with the Bank's standard payroll practices, commencing on the effective date of Employee's termination for the disability and ending on the earlier of: (i) the date of Employee returns to full time employment in his capacity as the Bank's President; (ii) Employee's full time employment by another financial institution; or (iii) the date of Employee's death. The Company may satisfy its obligations under this Section, at its option, through the purchase of disability insurance. The provisions of such policy will control the amounts paid to Employee.

Spouses who work full-time for, and are eligible to receive medical coverage from, any of the following entities will not be covered except as stated below: Federal Government, Federal Courts and Military Commonwealth of Pennsylvania Public School Districts, charter and cyber schools and other public school entities State System of Higher Education An employee whose spouse works for one of the above excluded employers may be covered by the District’s medical benefits, but only at an increased surcharge to the employee of $38 per pay in 2017-2018, $42 per pay in 2018-2019, $45 per pay in 2019-2020 and $50 per pay in 2020-2021. Such surcharge shall be in addition to the increased premium share for the appropriate tier. The District shall provide all permanent, full time teachers with medical and dental insurance as set forth in this Article. The Board reserves the right to provide equivalent coverage from an insurance carrier of its choosing.
Disability Illness. In the event Pook becomes disabled or ill during the term of this Agreement, and is unable, therefore, to perform his duties hereunder, CART agrees to pay Pook 80% of his retainer fee (the "disability payment") for a period of up to 12 months provided that this Agreement has not expired. However, regardless of the length of the term remaining in this Agreement at the time Pook becomes disabled or ill and unable to perform his duties, CART agrees that the disability payment shall be made for a period of no less than 8 months. The parties agree that if Pook is unable to resume his duties at the end of the 12-month period, this Agreement, and the parties' duties and obligations hereunder will expire.

  • Disability If, as a result of the Executive's incapacity due to physical or mental illness, the Executive shall have been absent from his duties with the Company on a full-time basis for six months and within 30 days after written notice of termination is thereafter given by the Company the Executive shall not have returned to the full-time performance of the Executive's duties, the Company may terminate this Agreement for "Disability."

  • Illness injury, or pregnancy-related condition of a member of the employee’s immediate family where the employee’s presence is reasonably necessary for the health and welfare of the employee or affected family member;

  • Disability Termination The term "Disability Termination" for ---------------------- purposes of this Agreement shall mean a termination of Executive's employment on or after the date Executive has a right immediately upon such termination to receive disability income benefits under SunTrust's long term disability plan or any successor to or replacement for such plan.

  • Total Disability (a) Total disability, as used in this Plan, means the complete inability because of an accident or sickness of a covered employee to perform all the duties of his/her own occupation for the first two (2) years of disability.   • Disability/Disabled For the purpose of this Agreement, an Executive will be considered disabled if:

  • Death; Disability If Executive’s employment terminates due to Executive’s death or Disability, then the Company shall pay or provide Executive (or the legal representative of his estate in the case of his death) with:

  • By Disability If Executive becomes eligible for the Company’s long term disability benefits or if, in the sole opinion of the Company, Executive is unable to carry out the responsibilities and functions of the position held by Executive by reason of any physical or mental impairment for more than ninety consecutive days or more than one hundred and twenty days in any twelve-month period, then, to the extent permitted by law, the Company may terminate Executive’s employment. The Company shall pay to Executive all compensation to which Executive is entitled up through the date of termination, and thereafter all obligations of the Company under this Agreement shall cease. Nothing in this Section shall affect Executive’s rights under any disability plan in which Executive is a participant.

  • Termination for Permanent Disability If Executive’s employment is terminated by the Company for Permanent Disability, Executive shall be entitled to receive (i) Executive’s fully earned but unpaid base salary, through the date of termination at the rate then in effect, plus all other amounts to which Executive is entitled under any compensation plan or practice of the Company at the time such payments are due, (ii) an amount equal to Executive’s annual base salary as in effect immediately prior to the date of termination, payable in a lump sum as soon as administratively practicable but in any event no later than two and one-half (2 1/2) months following the date of termination, (iii) an amount equal to Executive’s Bonus for the year in which the date of termination occurs prorated for the period during such year Executive was employed prior to the date of termination, payable in a lump sum as soon as administratively practicable but in any event no later than two and one-half (2 1/2) months following the date of termination, and (iv) for the period beginning on the date of termination and ending on the date which is twelve (12) full months following the date of termination (or, if earlier, the date on which Executive accepts employment with another employer that provides comparable benefits in terms of cost and scope of coverage), the Company shall pay for and provide Executive and his or her dependents with healthcare and life insurance benefits which are substantially the same as the benefits provided to Executive immediately prior to the date of termination, including, if necessary, paying the costs associated with continuation coverage pursuant to COBRA. In addition, if Executive’s employment is terminated by the Company for Permanent Disability, the vesting and/or exercisability of Executive’s outstanding Stock Awards shall be automatically accelerated on the date of termination as to the number of shares that would vest over the twelve (12) months following Executive’s date of termination under the applicable vesting schedules had Executive remained continuously employed by the Company during such period. Except as otherwise provided above with respect to accelerated vesting, if Executive’s employment is terminated by Permanent Disability, the provisions of the award agreements governing Executive’s Stock Awards regarding the exercisability of such Stock Awards following Executive’s disability shall apply.

  • Sickness In the event that an employee requires hospitalization or is seriously ill during his/her annual vacation period, the employee shall, upon request and upon presentation of a physician's statement, apply the period of illness or hospitalization to sick leave rather than vacation, provided the sick bank is not used. The employee must inform the College of the claim within one (1) week of returning to work.
