Diagnostic Data. From time to time, Seller may request, and Buyer shall furnish (to the extent it has the legal right to do so), certain data generated by the program, as reasonably required by Seller to perform its obligations under this clause. Such data will be treated as Buyer’s Proprietary Information in accordance with the clause entitled "Proprietary Information" regardless of the markings, screen displays, or other notices provided, or not provided, on or in conjunction with such data.

Diagnostic Data. You agree that Apple and its subsidiaries and agents may collect, maintain, process and use diagnostic, technical and related information, including but not limited to information about your computer, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to the Apple Software, and to verify compliance with the terms of this License. Apple may use this information, as long as it is in a form that does not personally identify you, to improve our products or to provide services or technologies to you.
Diagnostic Data. The Software may transmit diagnostic data relating to the Software, including, without limitation, system specifications and performance, capacity usage, system faults, and other information of a similar nature (collectively, “Diagnostic Data”) to OmniSci. Diagnostic Data may be sent on a periodic basis and upon a failure or fault in the Software. You may turn off the feature that sends Diagnostic Data automatically to OmniSci. In addition to the automatic transmission of Diagnostic Data, you may choose to provide additional data files (“Core Dumps”) to OmniSci for technical analysis in the context or receiving support. You hereby grant OmniSci a non-exclusive, worldwide, perpetual, irrevocable, transferable, sublicenseable, royalty free, fully paid-up license to access, use, reproduce, transmit, display, publish, distribute, modify, adapt and create derivative works from the Diagnostic Data and Core Dumps in connection with providing support, troubleshooting the Software and enhancing, improving, and developing the Software and related products and services. OmniSci will take commercially reasonable steps to protect your Diagnostic Data and Core Dumps from unauthorized access or disclosure. OmniSci reserves the right to disclose Diagnostic Data and Core Dumps (a) to OmniSci partners subject to confidentiality obligations to assist with specific support issues, or (b) in an anonymous and aggregated form that does not link such information to you or to any identifiable person.

If the licensee submits a support request or bug report which requires access to internal operational data of the ROCKITPLAY Cloud Service or ROCKIT RTE the licensee agrees on providing the relevant diagnostics data such as technical logs of ROCKITPLAY Cloud Service or ROCKIT RTE.

Diagnostic Data. If Licensee opts in to diagnostic and usage collection, The Licensee agrees that SOTI, its subsidiaries and agents may collect, maintain, process and use diagnostic, technical, usage and related information, including but not limited to technical information about the Licensee Device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of Software updates, product support and other services to the Licensee (if any) related to the Software, and to verify compliance with the terms of this License. SOTI may use this information, as long as it is collected in a form that does not personally identify the Licensee, to provide and improve SOTI’s products and services. To enable SOTI’s partners and third party providers to improve their software, hardware and services designed for use with SOTI products, SOTI may also provide any such partner or third party provider with a subset of diagnostic information that is relevant to that partner’s or provider’s software, hardware and/or services, as long as the diagnostic information is in a form that does not personally identify the Licensee.

Diagnostic Data. Component diagnostic data shall be available upon request of the network. If an error condition is self-detected on a component, then that condition, and any relevant diagnostic data, shall immediately be broadcast on the network.

Such data will be treated as Boeing's Proprietary Information in accordance with the clause entitled "Proprietary Information" regardless of the markings, screen displays, or other notices provided, or not provided, on or in conjunction with such data. h. Supplier shall provide Boeing one (1) year notice of intent to discontinue maintenance on any particular version of Licensed Software. i. Should Supplier choose to consolidate, merge, rename, split, repackage etc., the Licenses Software currently being used by Boeing, with any other software products it licenses, for whatever reason, Boeing will not be required to pay any additional maintenance fees, or the increased license fees, due to the consolidation, merge, rename, split or repackaging, fee for the acquisition of future licenses. If Boeing has requested the consolidation, merge, rename, split, repackage etc., Supplier and Boeing will mutually agree at the time of the consolidation on the approprieate increased fee. Should Boeing choose to accept the consolidated, merged, renamed, split, repackaged software Boeing would accordingly pay the higher price.
Diagnostic Data. The Parties agree that all Diagnostic Data will be deemed to be the Confidential Information of both Parties hereunder and subject to the protections set forth in Article 13, except as follows: (a) upon request of Expedia, TRX will promptly furnish any Diagnostic Data in its possession to Expedia, and (b) neither Party will share any Diagnostic Data with any Third Party without the prior consent of the other Party, not to be unreasonably withheld, conditioned or delayed. Notwithstanding the foregoing, if either Party reasonably believes that such Diagnostic Data must be shared with a Third Party in order to identify, assess or remedy a potential system issue, interoperability problem, or other error, then such Party may disclose such Diagnostic Data solely for such limited purpose, provided, that the disclosing Party will ensure that it has a written confidentiality agreement with the recipient Third Party at least as protective of the Diagnostic Data as the requirements set forth in this Agreement.
