DEVELOPMENT CONTROL. 51. As a condition of the development or redevelopment of any lot within the Plan; the provision, maintenance and use of the following facilities and matters are required and regulated as follows:

DEVELOPMENT CONTROL. 5.01 No Development, including excavation and landscaping improvements, shall take place within the Planned Area without application to the Municipality and its prior written approval as to conformity of such Development with the provisions of this Agreement, The Rural Municipality of Headingley Development Plan and Zoning By-laws and any amendments thereto, The Planning Act of Manitoba and Manitoba Building Code and all other relevant building codes.
DEVELOPMENT CONTROL. 58. The Subdivider acknowledges that as of the date of endorsement of this Agreement, deficiencies remain from Phase 1 (Plan 33M653) and Phase 2 (Plan 33M748), if applicable. The Subdivider hereby agrees and confirms that it shall fully address all such deficiencies during Phase 3 and that it shall be jointly and severally responsible for such deficiencies with Lucan Estates Inc.
DEVELOPMENT CONTROL. 3.1.1 The Successful Tenderer shall comply with the latest guidelines for agriculture developments that have been issued from time to time by the competent authority appointed under the Planning Act (Cap. 232) (“Competent Authority”).

Details of planning applications that may have archaeological implications will be requested from the weekly planning lists or may be automatically sent by the Local Planning Authority (LPA) as a result of consulting archaeological hazard maps.
