Designated Area. The FNQ DAMA Designated Area includes Australian postcodes 4852, 4854-4856, 4858-4861, 4865, 4868-4875, 4878-4883, 4885-4886 and 4895, within the Xxxxxx, Xxxxxxx, Mareeba, Tablelands, Xxxx, or Cassowary Coast local government areas, or the Xxxxxx Shire Council local government area, or the Weipa Town Authority area. Note that while most occupations are accessible throughout the Designated Area, a small number of occupations are excluded from postcodes 4868, 4869, 4870 and 0000 (Xxxxxx xxxxxxxxxxxx xxxx). The DAR will consider: Whether your business is operating within the Designated Area (or for ‘Limited’ occupations as indicated in the Occupation List, within the limited Designated Area), and has been doing so for at least 12 months unless exceptional circumstances exist. You may be asked to provide: o Evidence that the business is operating within the Designated Area for a period of at least twelve months (unless exceptional circumstances exist). The DAR will consider: Whether the position/s to be filled (as opposed to the business) will be located in the Designated Area (or the ‘Limited’ designated Area if applicable). The Overseas Worker may be able to travel outside the area for work-related reasons for short periods of time where this is consistent with the declared duties of the position. Note that you must seek the agreement of the Department of Home Affairs if the Overseas Worker will be outside of area for more than three out of twelve months.
Designated Area. You must locate and operate the Restaurant at an Authorized Location within the area described in Appendix B (the “Designated Area”). We and our affiliates will not locate and operate or grant to anyone else a franchise to locate and operate a Buffalo Wild Wings® restaurant within the Designated Area so long as this Agreement is in effect, except as provided in subparagraph 2.D. You do not have any right to sublicense or subfranchise within or outside of the Designated Area and do not have the right to operate more than one Restaurant within the Designated Area.
Designated Area. At any time during the Term, the Purchaser shall be entitled to transport the Excluded Assets to a designated area of the Premises at its own risk and peril, costs and expenses provided that prior to carrying out such transportation, the Purchaser will provide to all Access Parties and the Monitor, a description of the designated area of the Premises that the Excluded Asset will be transported to, the whole to the satisfaction of the applicable Access Party, acting reasonably. In carrying out any of its rights in this Section 2.3, the Purchaser shall (i) exercise reasonable care and diligence in transporting such Excluded Assets as if such Excluded Assets were assets of the Purchaser, (ii) comply, and cause its Representatives to comply, with all applicable industry standards and laws, including applicable environmental, health and safety and workers compensation laws and regulations, (iii) obtain any necessary permits and authorizations, and
Designated Area. Only the area designated in the Community Center Rental Agreement may be used. Any private areas or equipment are off limits.
Designated Area. Provided the local store management approves the dates proposed in Section 1 above, the Local Council may place one (1) sales booth or table, approved signage, and up to six Girl Scout members per booth (and there may be booths placed at each entrance based on agreement with Walmart or Sam’s Club local management). Booths must be located at least 15 feet from the entrances to and exits from the facility, to allow for safe ingress/egress. Store management reserves the right to change the designated area for the sales booth as necessary for the safety of shoppers. There must be at least one supervising adult Girl Scout staff or volunteer at each permitted sale booth. Girl Scout members, supervising adult staff, and/or volunteers may not solicit or distribute literature inside our facility, including in any lobby or vestibule, at any time.
Designated Area. If your request is approved, you may solicit and/or distribute literature only in the area we designate. We reserve the right to change the designated area if a change is necessary for the commercial operation of the facility. Designated Area. As a material inducement for the Company to enter into this Agreement, you hereby agree that, commencing on the date hereof and ending on the expiration of the Term, without the prior written consent of the Company (which consent may be withheld for any or no reason), you shall not, and shall cause your affiliates not to, acquire, directly or indirectly (including without limitation as a result of the acquisition of equity interests, merger or other transaction), or enter into any agreement containing the option or right to acquire any oil and gas interest or surface interest (including without limitation any form of hydrocarbon lease, top-lease, sublease or other leasehold, minerals, fee minerals, fee surface, royalties, overriding royalties, net profits interests, production payments, carried interests and/or other interests in production of hydrocarbons or lands) in any lands currently owned by the Company set forth in Exhibit A.
