Design Plans and Specifications. The Contractor shall strictly comply with any and all design plans and specifications provided to it by the District in connection with the materials and work. Failure to comply shall constitute a material breach of this Agreement. Contractor shall be responsible seeking clarification of any questions concerning design plans and specifications.
Design Plans and Specifications. Developer will agree to construct the Project substantially in accordance with the plans attached to this Agreement as Exhibit “A” (hereinafter “the Current Plans”) with respect to massing, setbacks, ground level retail space dimensions, internal residential and retail/commercial trash storage, design, and materials visible on the proposed building’s exterior, subject to any and all necessary modifications that may be required or requested in connection with obtaining any zoning ordinance(s), approval(s), and/or permit(s) from the City of Philadelphia and/or any other governmental agency (hereinafter, “Necessary Modifications”). Notwithstanding the foregoing, and subject to all such Necessary Modifications, the final plans for the Project shall have at least the following parameters: (a) The maximum height of the project will be 165 feet. (b) The Project will include ground level retail/commercial on the side of the building that fronts Chestnut Street. (c) The Project will not include above-grade parking. (d) The Project will include 60 internal bike storage spaces for residential occupants. (e) The Project will have enclosed, off-street trash storage for residential and retail/commercial occupants, which is to be accessed from the 2000 block of Ionic Street, substantially as shown in Exhibit “A”. (f) There will be no vehicle entrance, loading, or unloading on Chestnut Street.
Design Plans and Specifications. 5.1.1 The Tollway shall prepare Project construction plans, specifications, estimates and contract documents for bidding purposes and obtain County approval of final plans, specifications, estimates and contract documents. 5.1.2 The Tollway shall supply the County with final design plans, specifications and contract documents for bidding purposes. Said information shall be provided to the County no later than sixty (60) days prior to the bid date as determined by the County. 5.1.3 The Tollway shall finances the design engineering costs for the Project. Design engineering costs shall be applied to the overall Project cost estimate and the Tollway shall receive a credit as identified in Exhibit A.

Tenant's and/or Owner's failure to approve or disapprove the Design Plans and Specifications within such time shall conclusively be deemed approval of the Design Plans and Specifications. Tenant shall carry out the work of Improvements at its own risk and shall be solely responsible for ensuring that the Improvements are constructed and installed in accordance with the Design Plans and Specifications and in compliance with all Federal, State and local law and code requirements. Tenant shall also comply with the requirements for tenant's work contained in the Property Lease. Agency shall have no liability arising out of its involvement in the production of the Conceptual Design Plans or the Design Plans and Specifications.
