Denied Boarding Compensation. A. If a Passenger holding a Confirmed Reservation presents him or herself for carriage at the appropriate time and place, having complied fully with Carrier's requirements as to reservations and check-in, and if the flight for which the Passenger holds a Confirmed Reservation is oversold and due to over sales, Delux Public Charter is unable to accommodate the Passenger and departs without him or her, the Passenger shall be entitled to the denied boarding compensation described in Section 26B immediately below unless (i) the Passenger responds to Carrier’s request for volunteers and who willingly accepts Carriers’ offer of compensation, in any amount; or (ii) one of the exceptions to eligibility for denied boarding compensation in Section 26D below applies. For the sake of clarity, a Passenger who responds to Carrier’s request for volunteers and who willingly accepts Carrier’s offer of compensation shall not be considered to be involuntarily denied boarding and shall not be entitled to denied boarding compensation.

Denied Boarding Compensation. Employees are not entitled to payment offered for involuntarily denied boarding. Employees may retain compensation received for voluntarily vacating an airline seat provided the employee incurs no additional travel expenses beyond those which they would have normally incurred and vacating their seat does not interfere with the performance of official duties. To the extent an employee's travel is delayed during official duty hours by voluntarily vacating an airline seat, the employee shall be charged annual leave for the additional hours and may not earn travel compensatory time for any additional time in a travel status as a result of the voluntary action.
Denied Boarding Compensation. Airlines occasionally offer free tickets or cash allowances to compensate travelers for delays and inconvenience due to overbooking, flight cancellation, changes of equipment, etc. Travelers may volunteer for denied boarding compensation only if: • The delay in their trip will not cause an increase in the cost of the trip • The delay in their trip will not result in any interruption or loss of business The traveler is required to contact the designated travel management company during normal hours or through their 24 hour emergency contact number to advise the change to the itinerary. Travelers may keep the free travel voucher.

Charterer shall reimburse Hawaiian its actual out-of-pocket costs of all such documented denied boarding compensation within ten (10) days of submission of such invoice. Such rates are incorporated into this Agreement as Attachment B.
