Denial of Transfer. A request for transfer shall not be denied arbitrarily or capriciously.
Denial of Transfer. In cases where the Employer has decided not to transfer an Internal Applicant to a Vacancy position, the Employer will notify the Internal Applicant and the Union in writing of such decision, including an explanation of the Internal Applicant’s lack of qualifications, lack of skills, or inability to perform the tasks and responsibilities as defined for the Vacancy in Appendix A. Said response will be provided, in writing, within ten business days following the interview defined in Article 17.02.
Denial of Transfer. If a transfer request for a vacancy is denied, the teacher may request the reason(s) for denial. The reason for denial request by the teacher must be submitted, in writing, to the principal within five (5) days of the date of the notification letter that the vacancy has been filled. The principal shall set forth his/her reasons for denial, in writing, within five (5) days after receipt of the request from the teacher. Such reasons shall be based upon the criteria as stated in 7.4.
Denial of Transfer. Denial of transfer shall not be without basis in fact. At the employee's request any employee who is denied a transfer is entitled to a conference with the supervisor recommending the denial who shall provide reasons for the denial.
Denial of Transfer. Request When a requested re-assignment is not granted, the employee shall be given the courtesy of an interview, if requested, explaining the reason for such action.
Denial of Transfer. 18 If a transfer is denied, the unit member has a right to request a conference with 19 the Director of Human Resources-Classified.
Denial of Transfer. If, at any time, PDC determines that any portion of the PDC Contribution and the earnings thereon have been used for anything other than TIF- Eligible Expenses, PDC may deny any and all remaining transfers of the PDC Contribution contemplated under the Payment Schedule. In the event of such misuse of the PDC Contribution by the County, the County shall, within thirty (30) days of discovery, reimburse PDC in an amount equal to the amount used in violation of the TIF restrictions set forth in Section D hereof. Such reimbursement from the County shall not include any amounts still held by the County as the PDC Contribution. In addition, in the event of such misuse of the PDC Contribution by the County, PDC may unilaterally terminate this Agreement and demand an immediate return of any and all of the PDC Contribution previously transferred to the County that has not otherwise been spent on TIF-Eligible Expenses in connection with the Project, in which case any obligations of PSU shall thereby terminate. Notwithstanding the foregoing, cash management techniques that are regularly employed by the County in the ordinary course of business (e.g., time deposits, sweeping funds into overnight interest-bearing accounts, etc.) to earn interest on cash balances shall not be deemed a misuse of the PDC Contribution for purposes of this Agreement.
Denial of Transfer. If the application for transfer of the ABC License to Buyer is finally denied for any reason after due prosecution and exhaustion of all appropriate administrative remedies, then this Agreement shall terminate and the ABC Escrow shall be deemed cancelled and the Purchase Price shall be refunded to Buyer subject to the provisions of this Agreement. Termination of this Agreement and cancellation of the ABC License shall not prevent or bar either party from maintaining an action against the other to recover damages for the breach of any warranty, covenant or agreement by the party where the breach is the proximate cause for denial of the application for transfer of the ABC License.
Denial of Transfer. If the Fire Chief feels that such a transfer will interfere with the proper functioning of the department, he may deny the request. However, the affected employee may request a written explanation of the reasons for such denial. If the employee does not feel that the denial is justified, he may grieve such under Article XI.
Denial of Transfer. If a request for transfer is not granted, the employee will have the right to request, within six days, to meet with the Superintendent, or the Superintendent's designee, to discuss the specific reason(s) for the denial, and may, upon request, have the reason(s) stated in writing.
