Denial of Transfer. In cases where the Employer has decided not to transfer an Internal Applicant to a Vacancy position, the Employer will notify the Internal Applicant and the Union in writing of such decision, including an explanation of the Internal Applicant’s lack of qualifications, lack of skills, or inability to perform the tasks and responsibilities as defined for the Vacancy in Appendix A. Said response will be provided, in writing, within ten business days following the interview defined in Article 17.02.
Denial of Transfer. If a transfer request for a vacancy is denied, the teacher may request the reason(s) for denial. The reason for denial request by the teacher must be submitted, in writing, to the principal within five (5) days of the date of the notification letter that the vacancy has been filled. The principal shall set forth his/her reasons for denial, in writing, within five (5) days after receipt of the request from the teacher. Such reasons shall be based upon the criteria as stated in 7.4.

Notwithstanding the foregoing, cash management techniques that are regularly employed by the County in the ordinary course of business (e.g., time deposits, sweeping funds into overnight interest-bearing accounts, etc.) to earn interest on cash balances shall not be deemed a misuse of the PDC Contribution for purposes of this Agreement.

Denial of Transfer. If the application for transfer of the ABC License to Buyer is finally denied for any reason after due prosecution and exhaustion of all appropriate administrative remedies, then this Agreement shall terminate and the ABC Escrow shall be deemed cancelled and the Purchase Price shall be refunded to Buyer subject to the provisions of this Agreement. Termination of this Agreement and cancellation of the ABC License shall not prevent or bar either party from maintaining an action against the other to recover damages for the breach of any warranty, covenant or agreement by the party where the breach is the proximate cause for denial of the application for transfer of the ABC License.
Denial of Transfer. If the Fire Chief feels that such a transfer will interfere with the proper functioning of the department, he may deny the request. However, the affected employee may request a written explanation of the reasons for such denial. If the employee does not feel that the denial is justified, he may grieve such under Article XI.
