Common use of Demise of Premises Clause in Contracts

Demise of Premises. Landlord hereby demises and lets to Tenant, and Tenant hereby takes and leases from Landlord, for the term and upon the provisions hereinafter specified, the following described properties (hereinafter referred to collectively as the "Leased Premises" and each individually as a "Related Premises": (a) that portion of the land described in Exhibit "A-1" attached hereto upon which the Improvements containing rental office, fleet truck and trailer parking areas and related facilities are located, together with the Appurtenances related thereto, and together with a personal easement for the benefit of Tenant (and any permitted assignees or sublessees of Tenant's interests hereunder) granting the right of ingress and egress for vehicular and pedestrian access over and through the Common Areas (collectively, the "Land"); (b) the buildings, structures and other improvements now or hereafter constructed on the Land (collectively, the "Improvements"); and (c) the fixtures, machinery, equipment and other property described in Exhibit "B" on the Land or within any Improvements thereon (collectively, the "Equipment").

Demise of Premises. Landlord hereby demises and lets to Tenant, and Tenant hereby takes and leases from Landlord, for the term and upon the provisions hereinafter specified, the following described properties (hereinafter referred to collectively as the "Leased Premises" and each individually as a "Related Premises": (a) that portion of the land described in Exhibit "A-1A-l" attached hereto upon which the Improvements containing rental officethe self-storage units and related facilities are located and designated "RV", fleet truck boat and customer trailer parking areas and related facilities are located, together with the Appurtenances related thereto, and together with a personal easement for the benefit of Tenant (and any permitted assignees or sublessees of Tenant's interests hereunder) granting the right of ingress and egress for vehicular and pedestrian access over and through the Common Areas (collectively, the "Land"); (b) the buildings, structures and other improvements now or hereafter constructed on the Land (collectively, the "Improvements"); and (c) the fixtures, machinery, equipment and other property described in Exhibit "B" on the Land or within any Improvements thereon (collectively, the "Equipment").

Demise of Premises. Landlord hereby demises and lets to Tenant, and Tenant hereby takes and leases from Landlord, for the term and upon the provisions hereinafter specified, the following described properties property (hereinafter referred to collectively as the "Leased Premises" and each individually as the "West Java Premises" and "Gibraltar Premises" each of which premises is more particularly described in the applicable description in Exhibit "A" attached hereto and made a "Related Premises": part hereof and shall include the portions of items (a), (b) and (c) of this Paragraph 1 located thereon or therein and appertaining thereto): (a) that portion of the land premises described in Exhibit "A-1A" attached hereto upon which the Improvements containing rental office, fleet truck and trailer parking areas and related facilities are locatedhereto, together with the Appurtenances related thereto, and together with a personal easement for the benefit of Tenant (and any permitted assignees or sublessees of Tenant's interests hereunder) granting the right of ingress and egress for vehicular and pedestrian access over and through the Common Areas (collectively, the "Land"); (b) the buildings, structures and other improvements now or hereafter constructed on the Land (collectively, the "Improvements"); and (c) the fixtures, machinery, equipment and other property described in Exhibit "B" on the Land or within any Improvements thereon hereto (collectively, the "Equipment").

Demise of Premises. Landlord hereby demises and lets to Tenant, and Tenant hereby takes and leases from Landlord, for the term and upon the provisions hereinafter specified, the following described properties property (hereinafter referred to collectively as as, the "Leased Premises" and each individually as a the "Related Wylie Premises": , "Lexington Premises" and "Murrysville Premises" each of which premises is more particularly described in the applicable description on Exhibit "A" attached hereto and made a part hereof and shall include the portions of items (a), (b) and (c) of this Paragraph 1 located thereon or therein and appertaining thereto): (a) that portion of the land premises described in Exhibit "A-1A" attached hereto upon which the Improvements containing rental office, fleet truck and trailer parking areas and related facilities are locatedhereto, together with the Appurtenances related thereto, and together with a personal easement for the benefit of Tenant (and any permitted assignees or sublessees of Tenant's interests hereunder) granting the right of ingress and egress for vehicular and pedestrian access over and through the Common Areas (collectively, the "Land"); (b) the buildings, structures and other improvements now or hereafter constructed on the Land (collectively, the "Improvements"); and (c) the fixtures, machinery, equipment and other property described in Exhibit "B" on the Land or within any Improvements thereon hereto (collectively, the "Equipment").

Demise of Premises. For and in consideration of the covenants and agreements contained herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Landlord hereby demises and lets leases to Tenant, Tenant and Tenant hereby takes and leases from Landlord, for the term and upon the provisions hereinafter specifiedfollowing terms and conditions, approximately 4,441.7543 square meters, equivalent to 1.13 cuerdas of land (the “Land”) lying and being in the Mxxxxx Xxxx Xxxx of the Municipality of San Jxxx, Puerto Rico, and being more particularly described or depicted on Exhibit “A” attached hereto, together with all rights, easements and appurtenances pertaining thereto, including, without limitation, any and all rights of ingress and egress to streets, street beds and roadways, if any, associated therewith and all improvements (including, without limitation, the following described properties Buildings as such term is defined below) located thereon. The Land, the Buildings and all other improvements now or hereafter located thereupon and the rights, easements and appurtenances pertaining thereto are hereinafter collectively referred to as the “Premises”. The seven (7) floor office building currently located on the Premises is hereinafter referred to as the “Main Office Building” and the three (3) floor building structure currently located on the Premises is hereinafter referred to as the “Annex Building”. The Main Office Building and the Annex Building are hereinafter referred to collectively as the "Leased Premises" and each individually as a "Related Premises": (a) that portion of the land described in Exhibit "A-1" attached hereto upon which the Improvements containing rental office, fleet truck and trailer parking areas and related facilities are located, together with the Appurtenances related thereto, and together with a personal easement for the benefit of Tenant (and any permitted assignees or sublessees of Tenant's interests hereunder) granting the right of ingress and egress for vehicular and pedestrian access over and through the Common Areas (collectively, the "Land"); (b) the buildings, structures and other improvements now or hereafter constructed on the Land (collectively, the "Improvements"); and (c) the fixtures, machinery, equipment and other property described in Exhibit "B" on the Land or within any Improvements thereon (collectively, the "Equipment")“Buildings”.

Demise of Premises. Landlord hereby demises and lets to Tenant, and Tenant hereby takes and leases from Landlord, for the term and upon the provisions hereinafter specified, the following described properties property (hereinafter referred to collectively as collectively, the "“Leased Premises" and each individually as a "Related Premises": ”): (a) that portion of the land described in Exhibit "A-1" “A” attached hereto upon which the Improvements containing rental office, fleet truck and trailer parking areas and related facilities are locatedhereto, together with the Appurtenances related theretoAppurtenances, commonly known as and together with a personal easement for by the benefit street address of Tenant 000 X. Xxxxx Ave, Kalamazoo, MI 49004 (and any permitted assignees or sublessees of Tenant's interests hereunder) granting the right of ingress and egress for vehicular and pedestrian access over and through the Common Areas (collectively, the "“Land"”); (b) the buildingsexisting building(s) described on Exhibit “A” attached hereto and currently comprised of a 67,000 square foot indoor cultivation and processing area together with a 3,000 square foot retail dispensary (individually or collectively, as the case may be, the “Building”), and all structures and other improvements or betterments now or hereafter constructed on the Land (collectively, with the "Building, the “Improvements"”); and (c) the any Greenhouse Systems and together any other fixtures, machinery, and equipment and other property used in connection with operation of the Building as a building as described in on Exhibit "“B" on the Land or within any Improvements thereon ” attached hereto (collectively, the "Equipment"“Building Systems and Components”), but excluding any of the Tenant’s Personal Property.

Demise of Premises. Landlord hereby demises and lets leases to Tenant, Tenant and Tenant hereby takes and leases from Landlord, Landlord for the term and upon the provisions hereinafter specified, specified the following described properties (hereinafter referred to collectively as the "Leased Premises" and each individually as a "Related Premises": (a) that portion of the land described in Exhibit "A-1" attached hereto upon which the Improvements containing rental office, fleet truck and trailer parking areas and related facilities are located, together with the Appurtenances related thereto, and together with a personal easement for the benefit of Tenant (and any permitted assignees or sublessees of Tenant's interests hereunder) granting the right of ingress and egress for vehicular and pedestrian access over and through the Common Areas property (collectively, the "LandLEASED PREMISES"): (i) the lot or parcel of land described on Exhibit A attached hereto and made a part hereof, together with the easements, rights, and appurtenances thereunto belonging or appertaining ("LAND"); (bii) the buildings, structures structures, and other improvements now located or hereafter constructed on the Land (collectively, the "ImprovementsIMPROVEMENTS"); and (ciii) the fixturesmachinery and equipment which are attached to the Improvements in such a manner as to become fixtures under applicable law, machinerytogether with all additions and accessions thereto, equipment substitutions therefor and other property described in Exhibit "B" on the Land or within any Improvements thereon replacements thereof permitted by this Lease (collectively, the "EquipmentEQUIPMENT"), excepting therefrom the Trade Fixtures (as hereinafter defined). Attached hereto as Exhibit E and Exhibit F, respectively, are schedules listing the Equipment and the Trade Fixtures, as the same exist on the date hereof.

Demise of Premises. Landlord hereby demises and lets to Tenant, and Tenant hereby takes and leases from Landlord, for the term and upon the provisions hereinafter specified, the following described properties property (hereinafter referred to collectively as the "Leased Premises" and each individually as the "Menomonie Premises" (comprised of (x) an office and manufacturing building containing approximately 66,596 square feet and (y) a warehouse building containing approximately 120,950 square feet) and "Related Oconomowoc Premises" (comprised of one building used for office and laboratory space and containing approximately 40,835 square feet) each of which premises is more particularly described in the applicable description in Exhibit ": A" attached hereto and made a part hereof and shall include the portions of items (a), (b) and (c) of this Paragraph 1 located thereon or therein and appertaining thereto): (a) that portion of the land premises described in Exhibit "A-1A" attached hereto upon which the Improvements containing rental office, fleet truck and trailer parking areas and related facilities are locatedhereto, together with the Appurtenances related thereto, and together with a personal easement for the benefit of Tenant (and any permitted assignees or sublessees of Tenant's interests hereunder) granting the right of ingress and egress for vehicular and pedestrian access over and through the Common Areas (collectively, the "Land"); (b) the buildings, structures and other improvements now or hereafter constructed on the Land (collectively, the "Improvements"); and (c) the fixtures, machinery, equipment and other property described in Exhibit "B" on the Land or within any Improvements thereon hereto (collectively, the "Equipment").

Demise of Premises. The Leased Premises shall be comprised of four (4) parcels of Land, Improvements to be constructed thereon by Landlord and Equipment to be installed therein by Landlord, all as set forth in this Lease and the Construction Agency Agreement. Landlord hereby demises and lets to Tenant, and Tenant hereby takes and leases from Landlord, for the term and upon the provisions hereinafter specified, the following described properties property (hereinafter referred to collectively as the "Leased Premises" and each individually as the "Mendota Premises" "Toppenish Premises" "Yakima Premises" and "Plover Premises" each of which premises is more particularly described in the applicable description in Exhibit "A" attached hereto and made a "Related Premises": part hereof and shall include the portions of items (a), (b) and (c) of this Paragraph 1 located thereon or therein and appertaining thereto): (a) that portion of the land premises described in Exhibit "A-1A" attached hereto upon which the Improvements containing rental office, fleet truck and trailer parking areas and related facilities are locatedhereto, together with the Appurtenances related thereto, and together with a personal easement for the benefit of Tenant (and any permitted assignees or sublessees of Tenant's interests hereunder) granting the right of ingress and egress for vehicular and pedestrian access over and through the Common Areas (collectively, the "Land"); (b) the buildings, structures and other improvements now constructed or hereafter to be constructed on the Land by Landlord (collectively, the "Improvements"); and (c) the fixtures, machinery, equipment equipment, including conveyor equipment, and other property to be installed in the Improvements by Landlord described in Exhibit "B" on the Land or within any Improvements thereon hereto (collectively, the "Equipment").

Demise of Premises. Landlord hereby demises and lets to Tenant, and Tenant hereby takes and leases from Landlord, for the term and upon the provisions hereinafter specified, the following described properties property (hereinafter referred to collectively as the "Leased Premises" and each individually as the "Arizona Premises" and the "California Premises" each of which premises is more particularly described in the applicable description in Exhibit "A" attached hereto and made a "Related Premises": part hereof and shall include the portions of items (a), (b) and (c) of this Paragraph 1 located thereon or therein and appertaining thereto): (a) that portion of the land premises described in Exhibit "A" hereto relating to the Arizona Premises ("Arizona Land") and the premises described in Exhibit "A-1" attached hereto upon which relating to the Improvements containing rental office, fleet truck and trailer parking areas and related facilities are locatedCalifornia Premises (the "California Land"), together with the Appurtenances related thereto, and together with a personal easement for the benefit of Tenant (and any permitted assignees or sublessees of Tenant's interests hereunder) granting the right of ingress and egress for vehicular and pedestrian access over and through the Common Areas (collectively, the "Land"); (b) the buildings, structures and other improvements now or hereafter constructed on the Land (collectively, the "Improvements"); and (c) the fixtures, machinery, equipment and other property all as described in Exhibit "B" on the Land or within any Improvements thereon hereto (collectively, the "Equipment").
