Delays during construction. Without prejudice to the provisions of Clause 10.3 (ii), in the event the Contractor does not achieve any of the Project Milestones or the Authority’s Engineer shall have reasonably determined that the rate of progress of Works is such that Completion of the Project Highway is not likely to be achieved by the end of the Scheduled Completion Date, it shall notify the same to the Contractor, and the Contractor shall, within 15 (fifteen) days of such notice, by a communication inform the Authority’s Engineer in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Project Completion Date.
Delays during construction. Without prejudice to the provisions of Clause 12.4.2, if the Concessionaire does not achieve any of the Project Milestones or the Independent Engineer shall have reasonably determined that the rate of progress of Construction Works is such that the Bus Terminal is not likely to be achieved by the Scheduled Completion Date, it shall notify the Concessionaire to this effect, and the Concessionaire shall, within 15 (fifteen) days of such notice, by a communication inform the Independent Engineer in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Project Completion Date.
Delays during construction. If the Concessionaire does not achieve any of the Project Milestone or the Independent Monitor[s] shall have reasonably determined that the rate of progress of Construction Works is such that Project is not likely to be achieved by the Project Completion Date, it shall notify the Concessionaire to this effect, and the Concessionaire shall, within 15 (fifteen) days of such notice, by a communication inform the Independent Monitor[s] in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Project Milestone or Project Completion Date as the case may be.
Delays during construction. Without prejudice to the provisions of Clause 12.3 and 12.4 if the Concessionaire fails to achieve any of the Project Milestones, the Independent Engineer shall notify the Authority and the Concessionaire to this effect, and the Concessionaire shall, within 15 (fifteen) days of such notice, inform the Independent Engineer and the Authority in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the COD.
Delays during construction. Without prejudice to the provisions of Clause 14.1, if the rate of progress of Development Works is such that the Development Obligation is not likely to be completed within the time period stipulated, the Concessionaire shall inform the Independent Engineer and the Authority at fortnight intervals, in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Operation Date.
Delays during construction. Without prejudice to the provisions of Clause19.4.2, if the Mine Developer and Operator does not achieve any of the Project Milestones or the Independent Engineer shall have reasonably determined that the rate of progress of Construction Works and installation of Equipment is delayed, it shall notify the Mine Developer and Operator to this effect, and the Mine Developer and Operator shall, within 15 (fifteen) days of such notice, by a communication inform the Independent Engineer in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve such Project Milestones.
Delays during construction. Without prejudice to the provisions of Clause 8.3, if Seller does not achieve any of the Project Milestones set forth in Schedule F or the Independent Engineer shall have reasonably determined that the rate of progress of Construction Works is such that the Facility is not likely to be completed by the SCOD, it shall notify Seller and CEB to this effect, and Seller shall, within 15 (fifteen) days of such notice, by a communication through a formal letter inform the Independent Engineer and CEB in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Commercial Operation Date.
Delays during construction. 13.4.1 If the Concessionaire does not achieve any of the Project Milestones or the Authority shall have reasonably determined that the rate of progress of Construction Works is such that the Mandatory Project and Mandatory Sports Infrastructure Project Facilities are not likely to be completed by the Scheduled Completion Date, it shall notify the Concessionaire to this effect, and the Concessionaire shall, within 15 (fifteen) days of such notice, by a communication inform the Authority in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Scheduled Completion Date.
Delays during construction. Without prejudice to the provisions of Clause 10.2.2, if the Implementation Agency does not achieve any of the Project Milestones or the Project Consultant or the Authority shall have reasonably determined that the rate of progress of Construction Works is such that the Project is not likely to be completed by the Scheduled Completion Date, notify the Implementation Agency to this effect, and the Implementation Agency shall, within 15 (fifteen) days of such notice, by a communication inform the Authority and the Project Consultant in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve COD.
Delays during construction. Without prejudice to the provisions of Clause 12.4.2, if the Concessionaire does not achieve any of the Project Milestones or the Independent Engineer shall have reasonably determined that the rate of progress of Construction Works is such that Intermediate-laning/Two-Laning is not likely to be achieved by the Scheduled Intermediate-laning/Two-Laning Date, it shall notify the Concessionaire to this effect, and the Concessionaire shall, within 15 (fifteen) days of such notice, by a communication inform the Independent Engineer in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Project Completion Date.
