In particular, and not by way of limitation, by accepting payment after the due date of any amount payable under this Agreement, any Security Instrument, the Note or any the other Loan DocumentDocuments, Lender shall not be deemed to have waived any right either to require prompt payment when due of all other amounts due under this Agreement, the Security Instruments, the Note or and the other Loan Documents, or to declare a default for failure to effect prompt payment of any such other amount.

Delay Not a Waiver. Neither any failure nor any delay on the part of Lender in insisting upon strict performance of any term, condition, covenant or agreement, or exercising any right, power, remedy or privilege hereunder, or under the Note or under any other Loan Document, Document or any other instrument given as security thereforthe Environmental Indemnity, shall operate as or constitute a waiver thereof, nor shall a single or partial exercise thereof preclude any other future exercise, or the exercise of any other right, power, remedy or privilege. In particular, and not by way of limitation, by accepting payment after the due date of any amount payable under this Agreement, the Note or any other Loan DocumentDocument or the Environmental Indemnity, Lender shall not be deemed to have waived any right either to require prompt payment when due of all other amounts due under this Agreement, the Note other Loan Documents or the other Loan DocumentsEnvironmental Indemnity, or to declare a default an Event of Default for failure to effect prompt payment of any such other amount.

In particular, and not by way of limitation, by accepting payment after the due date of any amount payable under this AgreementTrust Deed, the Note Notes, or any other Loan Financing Document, Lender Beneficiary shall not be deemed to have waived any right either to require prompt payment when due of all other amounts due under this AgreementTrust Deed, the Note Notes, or the other Loan Financing Documents, or to declare a default for failure to effect prompt payment of any such other amount.

Neither any failure nor any delay on the part of Lender in insisting upon strict performance or compliance of any term, condition, covenant or agreement, or nor Lender’s delay in exercising any right, power, remedy or privilege hereunder, or under the Note or under any other Loan Document, or any other instrument given as security therefor, shall operate as or constitute a waiver thereof, nor shall a single or partial exercise thereof preclude any other future exercise, or the exercise of any other right, power, remedy or privilege. In particular, with respect to the Lender, and not by way of limitation, by accepting payment after the due date of any amount payable under this Agreement, the Note Agreement or any other Loan 54151.4 44 Document, Lender shall not be deemed to have waived any right either to require prompt payment when due of all other amounts due under this Agreement, the Note Agreement or the other Loan Documents, or to declare a default for failure to effect prompt payment of any such other amount.

In particular, with respect to Lender, and not by way of limitation, by accepting payment after the due date of any amount payable under this Agreement, the Note Agreement or any other Amended and Restated Loan Document, Lender shall not be deemed to have waived any right either to require prompt payment when due of all other amounts due under this Agreement, the Note Agreement or the other Amended and Restated Loan Documents, or to declare a default for failure to effect prompt payment of any such other amount.

Delay Not a Waiver. In particular, and not by way of limitation, by accepting payment after the due date of any amount payable under this AgreementAgree- ment, the Note Notes or any other Loan Document, Lender Lenders and Agent shall not be deemed to have waived any right either to require prompt payment when due of all other amounts due under this Agreement, the Note or the other Loan DocumentsDocu- ments, or to declare a default for failure to effect prompt payment of any such other amount.

Delay Not a Waiver. Neither any failure nor any delay on the part of Lender Mortgagee in insisting upon strict performance of any term, condition, covenant or agreement, or exercising any right, power, remedy or privilege hereunder, or under the Note Credit Agreement, or under any other Loan Transaction Document, or any other instrument given as security therefor, shall operate as or constitute a waiver thereof, nor shall a single or partial exercise thereof preclude any other future exercise, or the exercise of any other right, power, remedy or privilege. In particular, and not by way of limitation, by accepting payment after the due date of any amount payable under this Mortgage, the Credit Agreement, the Note or any other Loan Transaction Document, Lender Mortgagee shall not be deemed to have waived any right either to require prompt payment when due of all other amounts due under this Mortgage, the Credit Agreement, the Note or the other Loan Transaction Documents, or to declare a default for failure to effect prompt payment of any such other amount.

Delay Not a Waiver. Neither any failure nor any delay on the part of Lender any party hereto in insisting upon strict performance of any term, condition, covenant or agreement, or exercising any right, power, remedy or privilege hereunder, or under the Note or under any other Loan Document, or any other instrument given as security therefor, shall operate as or constitute a waiver thereof, nor shall a single or partial exercise thereof preclude any other future exercise, or the exercise of any other right, power, remedy or privilege. In particular, and not by way of limitation, by accepting payment after the due date of any amount payable under this Agreement, the any Note or any other Loan Document, neither any Agent nor any Lender shall not be deemed to have waived any right either to require prompt payment when due of all other amounts due under this Agreement, the any Note or the other Loan Documents, or to declare a default for failure to effect prompt payment of any such other amount.

Delay Not a Waiver.
