Definition of Layoff. A layoff for the purpose of this article shall be considered as an involuntary separation of a permanent or probationary classified employee due to lack of funds and/or work. A layoff is also a voluntary demotion or voluntary reduction of hours, workweek or work year accepted by a unit member to avoid interruption of employment by layoff. When a vacancy exists, a bargaining unit member may take a voluntary demotion or voluntary reduction in assigned time in lieu of layoff, provided that such bargaining unit member has the essential skills necessary to perform the duties of the position as specified in the incumbent's job announcement, and provided further that the district approves such demotion or reduction in time. Such approval shall not be withheld by the district for arbitrary or capricious reasons.
