Definition of "Education". Whenever provision is made in this Trust Agreement for payment for the "education" needs of Beneficiary, the terms "educational" or "education" shall be construed to include any accredited trade school, college, and postgraduate study, so long as pursued to advantage by Beneficiary, at an institution of Beneficiary's choice; and in determining the payments to be made for such trade school, college or postgraduate education, Trustee shall take into consideration Beneficiary's related living expenses to the extent that they are reasonable.

Definition of "Education". For purposes of this Will, the term "education" shall mean private or public elementary, high school, technical and preparatory schooling, college, university, graduate school, studies at accredited vocational, technical and arts schools, and all other types of general or special educational training. In addition, discretionary distributions for educational purposes may include distributions for specialized formal or informal training in music, the stage, handicrafts, the arts, or sports, whether by private instruction or otherwise, and any other activity, including travel (foreign or domestic) and recreational activities of an educational nature such as study programs, trips to foreign countries and summer camps, which tend to more fully develop the talents and potential of the beneficiary, regardless of age. Costs of education shall include the costs of all tuition, books and fees, together with costs of housing, food, clothing, transportation and ordinary living costs incurred in pursuit of such education, to the extent deemed appropriate by the Trustee. My Trustee may withhold distributions for education if, in the judgment of my Trustee, such education is not reasonably expected to contribute to and enhance the beneficiary's ability to become and remain financially self-supporting or if my Trustee determines that the beneficiary is not making an xxxxxxx effort to take full advantage of the educational opportunities so provided. Escrow Agent fees are not contingent in any way on the success or failure of the Offering, receipt of Subscriber funds, or transactions contemplated by this Agreement. No fees, charges or expense reimbursements of Escrow Agent are reimbursable, and are not subject to pro-rata analysis. It is acknowledged and agreed that no fees, reimbursement for costs and expenses, indemnification for any damages incurred by Issuer or Escrow Agent shall be paid out of or chargeable to the Escrow Amount.
