Common use of DEFECT LIABILITY Clause in Contracts

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty or provision of services or any other obligations of the Promoter/Developer as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer within a period of 5 (Five) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter/Developer to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's failure to rectify such defects within such time, the aggrieved Allottee shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer within a period of 5 (Five) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter/Developer to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's failure to rectify such defects within such time, the aggrieved Allottee shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. 15.1 It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement Agreement for sale Sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possession, save those as mentioned in clause 15.2 below, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under applicable laws for the Acttime being in force.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the PromoterVendor/Developer as per the agreement for sale this Agreement relating to such development is brought to the notice of the PromoterVendor/Developer within a period of 5 (Five) five years by the Allottee allottee from the date of handing over possession, it shall be the duty of the PromoterVendor/Developer to rectify such defects without further charge., within 30 (thirty) thirty days, and in the event of PromoterVendor/Developer's failure to rectify such defects within such time, the aggrieved Allottee Allottee(s) shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first plot of the 1st phase of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first apartment of the phase of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale this Agreement relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionhandover of possession of the Designated Unit or the Promoter obtaining the completion certificate, whichever is earlier, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. 12.1 It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale this Agreement relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 five (Five5) years by the Allottee Allottee(s) from the date of handing over possessionpossession or Deemed Date Of Possession or from the date of occupancy certificate, whichever is earlier, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 thirty (thirty30) days, and in the event of Promoter/Developer's failure to rectify such defects within such time, the aggrieved Allottee Allottee(s) shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale Agreement relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession and/or Deemed Date of Possession, whichever is earlier, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first flat of the 1st phase of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement Agreement for sale Sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possession and/or Deemed date of possession, whichever is earlier, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as may be provided under the ActAct or in absence thereof as may be mutually agreed.

DEFECT LIABILITY. 12.1 It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement Agreement for sale Sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionCompletion Certificate, save those as mentioned in clause 12.2 below, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the this agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's failure to rectify such defects within such time, the aggrieved allottees (including the Allottee herein if so aggrieved) shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first Apartment/Pent Housesof the “PHASE-07” of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. 12.1 It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter No.2 as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter No.2 within a period of 5 (Fivefive) years by the Allottee Allottee/s from the date of handing over possession, it shall be the duty of the Promoter/Developer Promoter No.2 to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's Promoter No.2’s failure to rectify such defects within such time, the aggrieved Allottee Allottee/s shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first EWS/LIG of the “PHASE-01” of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first LIG/ EWS flat of the 4th phase of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the this agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's failure to rectify such defects within such time, the aggrieved allottees(including the Allottee herein if so aggrieved) shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first row house of the 3rd phase of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement Agreement for sale Sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possession, save those as mentioned in clause 13.3 below, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) daysthirty)days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee shall be entitled to receive appropriate compensation in the manner as provided under applicable laws for the Act.time being in force. The Promoter shall not be liable to rectify any defect occurring under the following circumstances:

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first Villas of the “PHASE-02” of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first Duplex of the “PHASE-01” of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer as Developeras per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer within a period of 5 (Five) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter/Developer to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's failure to rectify such defects within such time, the aggrieved Allottee shall be entitled to receive appropriate compensation in compensationin the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first Duplexof the “PHASE-02” of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the PromoterOwner/Developer Vendor/Promoter as per the agreement for sale relating to such development is brought to the notice of the PromoterOwner/Developer Vendor/Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possession, it shall be the duty of the PromoterOwner/Developer Vendor/Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first Shops/Offices/Halls of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty or provision of services or any other obligations of the Promoter/Developer as Developeras per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer within a period of 5 (Five) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter/Developer to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's failure to rectify such defects within such time, the aggrieved Allottee shall be entitled to receive appropriate compensation in compensationin the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement Agreement for sale relating to such development is brought to the notice of the Promoter/Developer within a period Promoter till the date promoter handover the responsibility of 5 (Five) years maintainance of the Building in the hand of the Maintainance Authority, by the Allottee from the date of handing over possession, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession EWS/LIG/Flat of the 1st phase of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first plot of the 2nd phase of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first Apartment/Pent Housesof the “PHASE-05” of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first Duplex of the “PHASE-02” of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first Plot of the “XXXXX- 00” of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement Agreement for sale Sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession and/or Deemed date of possession ,whichever is earlier, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first LIG/ EWS flat of the 2nd phase of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. 14.1 It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale this Agreement relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the Possession Date or Deemed Possession Date or date of handing over possessionissuance of Completion Certificate, whichever is earlier, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first “EWS” UNIT of the “PHASE-03” of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's Promoter‟s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first house of the 1st phase of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first row house of the 1st phase of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first plot of the Whispering Palms Extension project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the PromoterVENDOR/Developer DEVELOPER as per the agreement for sale relating to such development is brought to the notice of the PromoterVENDOR/Developer DEVELOPER within a period of 5 (Fivefive) years by the Allottee from the date of handing over possession, it shall be the duty of the PromoterVENDOR/Developer DEVELOPER to rectify such defects without further charge., within 30 (thirty) days, and in the event of PromoterVENDOR/DeveloperDEVELOPER 's failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the PromoterDeveloper/Developer Promoter as per the agreement Agreement for sale Sale relating to such development is brought to the notice of the PromoterDeveloper/Developer Promoter within a period of 5 (Fivefive) years by the Allottee Allottee(s) from the date of handing over possession, it shall be the duty of the PromoterDeveloper/Developer Promoter to rectify such defects without further charge.charges, within 30 (thirty) days, days and in the event of Developer’s/Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottee(s) shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the PromoterPROMOTER/Developer DEVELOPER as per the agreement Agreement for sale Sale relating to such development is brought to the notice of the PromoterPROMOTER/Developer DEVELOPER within a period of 5 (Fivefive) years by the Allottee Allottee/Purchaser from the date of handing over possession, it shall be the duty of the PromoterPROMOTER/Developer DEVELOPER to rectify such defects without further charge., within 30 (thirty) days, and in the event of PromoterPROMOTER/Developer's DEVELOPER’s failure to rectify such defects within such time, the aggrieved Allottee Allottee/Purchaser shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first Duplexof the “PHASE-03” of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. 12.1 It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement Agreement for sale Sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee Allottee(s) from the date of handing over possession, save those as mentioned in clause 12.2 below, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under applicable laws for the Acttime being in force.

DEFECT LIABILITY. 12.1 It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement Agreement for sale Sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possession, save those as mentioned in clause 12.2 below, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's Project Manger failure to rectify such defects within such time, the aggrieved Allottee shall be entitled to receive appropriate compensation in the manner as provided under applicable laws for the Acttime being in force.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the [Apartment / Plot] and the common areas, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) thirty days, and in the event of Promoter/Developer's Promoter‘s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first Commercial Shop/Office of the 3rd phase of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter (Not applicable it defect is caused due to mishandling or by natural cause) as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Five) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the PromoterVendors/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the PromoterVendors/Developer Promoter within a period of 5 (Fivefive) years by the Allottee Allottee(s) from the date of handing over handover of possession, it shall be the duty of the Promoter/Developer Vendor to rectify such defects without further charge., within 30 (thirty) days, and in the event of Vendors/Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first plot of the “XXXXX- 00” of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the PromoterPromoters/Developer Owners as per the agreement for sale relating to such development is brought to the notice of the PromoterPromoters/Developer Owners within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionobtaining completion certificate, it shall be the duty of the PromoterPromoters/Developer Owners to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's failure Promoters’/Owners’ fail to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first EWS flat of the 3rd phase of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first flat of the 2nd Phase of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the PromoterVendor/Developer as per the agreement for sale relating to such development is brought to the notice of the PromoterVendor/Developer within a period of 5 (Fivefive) years by the Allottee Allottee(s) from the date of handing over possession, it shall be the duty of the Promoter/Developer to rectify such defects without further charge., within 30 (thirty) days, and in the event of PromoterVendor/Developer's failure to rectify such defects within such time, the aggrieved Allottee Allottee(s) shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first Apartment/Pent Houses of the “PHASE-01” of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the PromoterOwner/Vendor/Developer as per the agreement for sale this Agreement relating to such development is brought to the notice of the PromoterOwner/Vendor/Developer within a period of 5 (Five) five years by the Allottee allottee from the date of handing over possession, it shall be the duty of the PromoterOwner/Vendor/Developer to rectify such defects without further charge., within 30 (thirty) thirty days, and in the event of PromoterOwner/Vendor/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottee(s) shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first Plot/Bungalow of the 1st phase of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer within a period of 5 (Five5(five) years by the Allottee Allottees from the date of handing over possession, it shall be the duty of the Promoter/Developer to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee shall Allottees will be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession or receipt of the completion certificate whichever is earlier, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first plot of the plot in Dweepam A-1 phase project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first Apartment/Pent Housesof the “PHASE-04” of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. 13.1 It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement Agreement for sale Sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possession, save those as mentioned in clause 13.3 below, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's Promoter‟s failure to rectify such defects within such time, the aggrieved Allottee shall be entitled to receive appropriate compensation in the manner as provided under applicable laws for the Acttime being in force.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first Commercial Space of the phase of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the PromoterOwner/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the PromoterOwner/Developer Promoter within a period of 5 (Fivefive) years by the Allottee Allottee/Purchaser from the date of handing over possession, it shall be the duty of the PromoterOwner/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Owner/Promoter/Developer's failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession or the date of issue the completion/occupancy certificate, whichever is earlier, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee shall be entitled to receive appropriate compensation in the manner as provided under the Act.

DEFECT LIABILITY. It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first house of the 2nd phase of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter except any disturbance arising to electricity supply/ items/ Equipments & other fittings as per the agreement Agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possession, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first Residential Cum Commercial Plot of the “PHASE-03” of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's Promoter‟s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.

It is agreed that in case any structural defect or any other defect in workmanship, quali ty quality or provision of services or any other obligations of the Promoter/Developer Promoter as per the agreement for sale relating to such development is brought to the notice of the Promoter/Developer Promoter within a period of 5 (Fivefive) years by the Allottee from the date of handing over possessionpossession of the first Apartment/Pent Housesof the “PHASE-06” of the project, it shall be the duty of the Promoter/Developer Promoter to rectify such defects without further charge., within 30 (thirty) days, and in the event of Promoter/Developer's ’s failure to rectify such defects within such time, the aggrieved Allottee Allottees shall be entitled to receive appropriate compensation in the manner as provided under the Act.
