Default Not a Condition of a 120-Day Demand. Notwithstanding any of the other terms of this Agreement, including, without limitation, the preceding provisions of this Section 9, the Lender shall have the right to demand payment of the outstanding Advances at any time, upon 120 days' prior written notice to the Borrower, whether or not any Default or Event of Default exists or the Expiry Date has occurred.
