Common use of Default by Developer Clause in Contracts

Default by Developer. In addition to such other remedies at law or in equity for default that ACHD may have, in the event Developer fails or neglects to perform its obligations under the terms and provisions of this Agreement in the time and manner required herein, ACHD may withhold any reimbursement due to Developer hereunder until such defaults are corrected to the satisfaction of ACHD.

In addition to such other remedies at law or in equity for default that ACHD may have, in the event Developer fails or neglects to perform its obligations under the terms and provisions of this Agreement in the time and manner required herein, ACHD may withhold any reimbursement due require Developer, upon written notice, to Developer hereunder until such defaults are corrected either (i) restore the property to the satisfaction condition existing as of ACHDthe date of this Agreement, (ii) alter the property to a reasonable alternative use, or (iii) reimburse ACHD for all fees and costs associated with either of the foregoing in the event that ACHD elects to direct and/or perform such work.
